The property is within the foreground of the Wheeler Opera House view plane and located in the Commercial Core Historic District but is not considered a designated landmark or a contributing structure. This application is submitted on behalf of 315 East Hyman Avenue LLC and replaces the previously submitted Minor Development application associated with case number LPA- 22-102 which we respectfully withdraw. The building was designed by Ted Mularz and Don Marek in 1976/1977 according to Aspen Building Department records. Ted Mularz is a recognized AspenModern architect and is associated with Wrightian/organic style of architecture. He worked in Fritz Benedict's office with Robin Molny and opened his own architecture firm in Aspen in 1963. The proposed changes bring non-compliant aspects of the property into compliance, repair drainage problems, and include minor updates to make the building better function. At some point in the past, an existing elevator with decommissioned without building permits.The elevator area is incorporated into the proposed floor area calculations to address this past alteration. Floor area and net leasable area are decreased with this proposal due to an increase in circulation and shared spaces like common bathrooms.A decrease in both floor area and net leasable area exempts this project from growth management review. The plywood covering the roof of the existing trellis at Wild Fig is removed in this application as requested by Community Development. The open trellis remains with no solid covering. Roof changes • A large portion of the existing rooftop mechanical equipment, venting and ductwork is proposed to be replaced and brought into compliance with current Code requirements. • Metal flashing is proposed to address roof drainage issues. This will increase height about 5" as the flashing needs to be attached to the existing building. The roof membrane is also proposed to be replaced to improve drainage issues. • Screen mechanical equipment on southern roof plane. South elevation changes • Replacement of the existing metal grate that screens utilities. • Add wood to interior walls of entrance vestibule. • Add steel plate to brick adjacent to Wagner Park entrance. Steel plate will be attached to mortar and will not damage brick. • Replace guard rail near Wagner Park entrance. Lower level (courtyard) changes • Remove a door and small vestibule at bottom of existing stairs. • Add exterior door at bottom of existing stairs. Historic Preservation — No Negative Effect As discussed with the Planning Director Amy Simon, this project qualifies for a Certificate of No Negative Effect application due to the limited scope and the status of this building as non-historic within a historic district. 26.415.070. Development involving designated historic property or property within a historic district (2) The Community Development Director shall issue a development order based upon a certificate of no negative effect within fourteen (14) days after receipt of a complete application if: Page 2 of 8 a. It is determined that the activity is an eligible work item and meets the City Historic Preservation Design Guidelines; and b. Any modifications to the proposed work requested by the Community Development Director are agreed to by the owner/applicant; and c. The proposed work will not diminish, eliminate or adversely affect the significant historic and/or architectural character of the subject property or Historic District in which it is located. Response—The proposed work is eligible for a certificate of no negative effect as it meets criteria 4.e and 4.g below. The scope of work does not adversely impact the historic district or any adjacent historic landmarks. Cleaning up of the rooftop mechanical equipment and adding a mechanical screen enhances views from the Wheeler Opera House and the surrounding designated Pedestrian Malls. (4) The following work shall be considered for a Certificate of No Negative Effect: a. Replacement or repair of architectural features which creates no change to the exterior physical appearance of the building or structure. b. Replacement or repair of architectural features that restores the building or structure to its historic appearance. c. Installation of awnings or similar attachments provided no significant feature is damaged, removed or obscured by the installation. d. Fencing that has no adverse effect on the historic or architectural character of the property. e. Mechanical equipment or accessory features that have no impact on the character- defining features of the building or structure. f Signs which have no effect on the character-defining features of the historic property. g. Alterations to noncontributing buildings within historic districts that have no adverse effect on its historic or architectural character. h. Alterations to no more than two(2)elements of nonprimary facades of a designated building. i. Installation of site improvements, such as walkways, patios, pools or hot tubs, or similar significant features. Commercial Design Exemption The limited scope qualifies as exempt from Commercial Design review as noted below. 26.412.020 Commercial Design Review Applicability (c) Remodels. Where work is proposed on any element of an existing building that is addressed by the Commercial Design Review and that is not in compliance with the Commercial, Lodging or Historic District Design Standards and Guidelines or Section 26.412.070, Pedestrian Amenity, the applicant shall make a reasonable effort to bring that element into compliance. The Community Development Director may grant exceptions for Page 3 of 8 remodels that would require significant additional work above and beyond the scope of the remodel in order to ensure that all features are brought into compliance. Response — The majority of the proposed scope of work does not change aspects of the exterior building that are addressed by the Standards and Guidelines. The proposed changes on the lower level —filling in an alcove, removing a door, and adding a door—are not visible from street level and are not addressed by the Guidelines and Standards. Existing mechanical equipment is proposed to be removed and replaced with compliant mechanical equipment that meets setback requirements and is screened per the Guidelines and Standards noted below. The proposed mechanical upgrade removed non- compliant equipment, venting, and duct work. An existing utility area on the south elevation facing Wagner Park is proposed to have a new metal screen depicted on Sheet A020 of the drawing set. 1.30 Mechanical equipment, ducts, and vents shall be accommodated internally within the building and/or co-located on the roof. • Screen rooftop mechanical equipment and venting with a low fence or recess behind a parapet wall to minimize visual impacts. 1.31 Minimize the visual impacts of utility connections and service boxes. • Group and discreetly locate these features. • Use screening and materials that complement the architecture. Wood and a steel plate are proposed in the entrance alcove and adjacent to the door of the Wagner Park façade (south elevation). A guard rail is proposed to be replaced on the south elevation as well. Brick is not proposed to be painted and the materials, shown on Sheet 020 of the drawing set, can be attached to the mortar to avoid damaging the existing brick. Metal flashing is proposed to replace failing drainage around the perimeter of the entire building. The proposed wood and metal are appropriate secondary materials for a non-historic building within the Commercial Core Historic District and meet Standards 1.22 and 1.23. 1.22 Complete and accurate identification of materials is required. • Provide drawings that identify the palette of materials, specifications for the materials, and location on the proposed building as part of the application. • Physical material samples shall be presented to the review body. An onsite mock-up prior to installation may be required. 1.23 Building materials shall have these features: • Convey the quality and range of materials found in the current block context or seen historically in the Character Area. • Convey pedestrian scale. Page 4 of 8 • Enhance visual interest through texture, application, and/or dimension. • Be non-reflective. Shiny or glossy materials are not appropriate as primary material. • Have proven durability and weathering characteristics within Aspen's climate. • A material with an integral color shall be a neutral color. Some variation is allowed for secondary materials. Pedestrian Amenity space is unchanged. Second tier amenity space is met onsite as demonstrated in Tables 1 and 2, and Sheet A026 of the drawing set. Tenant spaces are shown on the plans as autonomous leased spaces that can lock off from the rest of the building. Unit 301 (Wild Fig) is to remain unchanged. The space has an internal bathroom and is physically separate from the rest of the building. Lower level Unit 102, 103, 104, 105 are assigned to Unit 301 (Wild Fig) which is the current condition. Unit 303 (Unravel) is a coffee shop. A collapsible gate is located at the stairs and ADA lift allowing this space to function separately when it is closed. Unravel has access to common bathrooms and the elevator when the business is open. Page 5 of 8 Unit 305 is proposed to be co-working space. Per the Commercial Core Zone District, this office space is allowed on the ground floor because the building is split level. Regardless of the exemption, the proposed office space is located more than 40 feet setback from the property line and is "recessed behind the frontmost street facing façade." Commercial spaces are separated by common hallways and a lobby. The bathrooms between Units 301, 303, and 305 are common for the building, and as such qualify as non- unit space. Second Tier Space On the lower level, Unit 200-0 is the kitchen for Units 201 and 204 (the bar and restaurant). Unit 200-1 are ski lockers accessory to Unit 200-2 which is proposed to be retail use (likely a ski shop). Unit 205 is a gym. On the basement level, Units 106, 107, 108, 109 and 110 are back of house, storage, and employee room for the restaurant and bar on the lower level. Please note that tenants may change the name of the businesses noted above and that all spaces are considered commercial use (restaurant or bar on main and lower levels); office use (coworking space on main level); or service use (fitness gym on lower level). View plane Exemption A view plane exemption is requested for the elevator enclosure and for replacement mechanical equipment on the roof. Most of the mechanical has been relocated to the rear of the roof toward Wagner Park. Removal and cleanup of existing mechanical equipment and ducts near the Hyman Avenue façade is proposed in addition to mechanical screening. 26.435.050.d Mountain view plane exemptions (d) Exemptions. The following development activities on properties located in the mid- and background of a view plane are exempt from the provisions of this Section and may proceed directly to zoning compliance check and building permit review, where the applicant shall demonstrate the improvement meets the following review criteria. (2) Attached Building Features. a. Attached building features, including those features listed in Section 26.575.020(f)(4), Allowed Exceptions to Height Limitations, and mechanical equipment or building appurtenances (including but not limited to a satellite dish, HVAC equipment, stairwell enclosure, elevator shaft, ventilation equipment, or skylights) that are added to an existing building are exempt only with the following setbacks and when the height of the feature complies with Section 26.575.020(f)(4), Allowed Exceptions to Height Limitations: Foreground: Greater than 50% of the lot length (minimum) (as measured from the front lot line) Page 6 of 8 b. All mechanical and ventilation equipment, including the replacement of existing equipment, located within a view plane shall require a mechanical permit, be installed to the minimum height required per manufacturer standards, and shall not be visible from the reference point and from the street level. Response - New mechanical equipment is setback at least 50% from the property line closest to Hyman Avenue, and is 15' setback from edge of roof. New venting is setback both 50% of the lot depth and 20' from the edge of roof. Existing roof plan is found on Sheet A007 and the proposed roof plan is on Sheet A011. Mechanical equipment and proposed screening will not exceed the maximum height of 6 feet as measured from the point of attachment to the roof per Land Use Code Section 26.575.020.f.4. 3View plane studies on Sheets A015, A016, A017, and A019 show the minimal impact of the new mechanical equipment on the actual viewpoint considering the existing building block much of the view already. The proposed screening complies with current code, and the relocation of existing equipment to the southernmost section of the roof cures an existing non-conformity. The rooftop equipment above the existing Wild Fig restaurant space is not proposed to change and is not in the scope of this application. Growth Management Exemption This project reduces floor area and net leasable area, and is therefore exempt from growth management requirements. Existing and proposed numbers are provided in Table 3. Hyman Avenue in Aspen, Colorado. This is to verify that the property can be redeveloped while meeting the City of Aspen Urban Runoff Management Plan(URMP)requirements. The existing building located on the property is two(2) stories and with adjacent,on property hardscape,includes a total impervious area of 8,806 square feet. As part of the proposed improvements,we are proposing the capture all roof and patio areas and route the associated runoff to a water quality detention tank. To the best of our knowledge,the patio drains and roof drains are already routed to a centralized drywell. Since the drainage from the property is not conveyed to an adjacent right-of-way,it is necessary to provide detention for the hardscape improvements on site and in this case the detention quantity can include the water quality volume. DETENTION VOLUME CALCULATION: In this case we are proposing to provide 100%detention for the project which can be calculated by multiplying the hardscape area by the 100-year storm precipitation depth of 1.23 inches. Therefore,the detention volume is as follows: Vdetention=Area x Precipitation depth Vdetention= 8,806 ft3 x 1.23 in/(12 in/ft)=902.6 ft3 A water quality detention tank 16 feet long, 8 feet wide and having an 8-foot storage depth will provide(16 ft x 8 ft x 8 ft) 1,024 ft3 of detention volume. OUTFALL: Storm water that is conveyed to the water quality detention tank will eventually percolate into the surrounding soil matrix which consists of sand and river cobbles,known to drain at acceptable percolation rates. It has com eto our attention that the roofs on the building are in poor condition and will need to be re-roofed. Wealso believe that they are not draining properly and would like to correct this during the reroofing process.This will require us to rem are the existing flashing around the roofs add 4"-6" of tapered foam then add a layer of new TPO roofing in light grey(this will not be visible from the street level.) Then add back new flashing to m ach what was previously there. 2) Add/replace m echanical equipm eit on the south upper roof. This new equipm ent will be fully enclosed in a new screen but som educts will need to exit the screening to reach where they will penetrate the roof. All the ducts will be painted a dark grey(alm cst black) Wewill also repaint any existing ductwork that we will be leaving. The m e hanical screen on the upper roof is 5'-7 1/4"tall above the existing roof and is set back 15'-0" from the northern edge of the upper roof. This equipm ent is needed to provide code-required ventilation to all the spaces of the building. 3) Remove the electrical service panel that was need to be installed for the recent coffee shop renovation. This service entrance will be m cved inside the sm dl electrical room next to the rear door. 4) If required install a new detention tank below the lower courtyard. Wewill return the lower courtyard to the previous condition once the tank is installed. 5) Fix broken Snowm dt in front of the west wing of the building in the city right-of-way. 6) Replace a storefront window in the courtyard with a new door for the ski lockers. 7) Fill in the entry alcove to the old offi ce, off the lower courtyard stair. The wall will be finished to match the beige stucco that is next to the stucco. 8) Replace the guardrail at the south W anger Park entrance. 9) Add steel and wood siding to the South W anger park entrance to m dce it feel less like a rear entrance. 10) Paint the rear wall of the South W anger park entrance. 11) Replace the electrical room gate with a new gate of a tube steel fram eand laser cut panel. 12) Replace the vent grate above the electrical room gate with a new cover to match the gate. STUDIOLEMONADE Item s1-5 are item sthat we will need to do in som eform but their im p3ct could be reduced from what we are showing in the revised plans. Item 6 is required if we want the space that the door is accessing to be a separate tenant.
