Cooper Encroachment Memo Below is a response to the requested items that outline the hardship for our ventilation for the restaurant located at 614 E. Cooper. 1. Formal Letter of hardship which outlines: a. Whether the requested encroachment is the minimum encroachment necessary to make possible the reasonable use of the parcel, building or structure in question. 1. RESPONSE: The penetrations and equipment located as close as possible to the building's structure minimize encroachment into the alley. We will attach the unit within the minimum clearance required; the projection into the alley will be less than the overall depth of the dumpsters below. b. Whether denial of the encroachment would cause the applicant unnecessary hardship or practical difficulty. 1. RESPONSE: The denial of the encroachment would be a hardship to the tenant as the exhaust hood for the restaurant would be necessary for the space's operation. c. Whether there are special circumstances or conditions which are unique to the parcel, building or structure in question which are not applicable to other parcels, buildings or structures 1. RESPONSE: The current space does not offer a vertical shaft for ducting and is only limited to exterior wall penetrations on the alley side. Similarly, the neighboring restaurant (Mezzaluna) has also ventilated the exhaust into the alley, showing similar limitations based on the building. d. Why other options cannot be pursued. 1. RESPONSE: The unit in question has no other options. It is flanked by tenants on either side and the building owner's office space directly above it. Reviewed by Engineering Development It should be known that this review shall not relieve the applicant of their responsibility to comply with the requirements of the City of Aspen. The review and approval by the City is offered only to assist the applicant's understanding of the applicable Engineering Development Requirements. The issuance of a permit based on construction documents and other data shall not prevent the City of Aspen from requiring the correction of errors in the construction documents and other data. 08/26/2024 3:17:41 PM
