Dear City of Aspen Zoning Officer Kyla Smits,
Please consider our responses below and associated attachments to the Zoning Review
Comments received on Friday May 27th, 2022.
1. The Total Lot Area shown on A001 Cover Sheet, A006 Existing Site Plan and A007
Proposed Site Plan does not match the Survey.
The Total Lot Area has been revised to 2,948 SF on Sheets A001 Cover Sheet, A006
Existing Site Plan, and A007 Proposed Site Plan matching the Survey.
2. Building height is limited to 15ft. The building height max shown on A001 Cover Sheet,
A007 Proposed Site Plan, A201 East & West Elevations, A202 North & South
Elevations, and A301 Sections of 16'-0" does not comply with the 15ft building height
limit in Smuggler Park Subdivision.
Please refer to the revised section 4/A301 on sheet A301 showing the proposed bldg
height measurement taken from the ground to the midpoint between the eave and ridge
per Chapter 26.575 Figure 18.
3. The max allowable FA is 2000sf + 500sf for a garage or shed. Per Ord. 40, Series of
1990 and 3rd Amendment recorded Jan. 7th 1993, adopted in December of 1992.
The max allowable floor area listed on A002 Zoning Summary has been revised to
2000sf + 500sf for a garage or shed per Ordinance 40, Series of 1990 and 3rd
Amendment recorded Jan. 7th 1993, adopted in December of 1992.
4. The Survey states a different lot area. Please Correct. (In reference to existing and
proposed gross lot area listed on A002 Zoning Summary)
The existing and proposed Gross Lot Area listed on A002 Zoning Summary has been
revised to match the Survey.

5. The height limit for Smuggler Mobile Home Park is 15ft. (In reference the Height Over
Topo Elevation on A002 Zoning Summary)
Please refer to the revised Section 4/A301 on sheet A301 as well as the revised Height
Over Topo Elevation on sheet A004 showing the proposed bldg height measurement
taken from the ground to the midpoint between the eave and ridge per City of Aspen
Municipal Code Chapter 26.575 Figure 18.
6. 309 Oak Lane is on the corner (In reference to the Zoning Allowance & Project Summary
table on A002 Zoning Summary)
The lot information has been revised in the Zoning Allowance & Project Summary table
on A002 Zoning Summary to accurately state that 309 Oak Lane is a corner lot.
7. The height max. in Smuggler Park is 15ft, not 16ft. The roof height max would be 7958.2
ft. (In reference to the Roof Ridge Calculations on A007 Proposed Site Plan)
Please refer to the revised Section 4/A301 on sheet A301 as well as the revised Height
Over Topo Elevation on sheet A004 showing the proposed bldg height measurement
taken from the ground to the midpoint between the eave and ridge per City of Aspen
Municipal Code Chapter 26.575 Figure 18.
8. Needs to be within 1 year of permit submittal. (In reference to stated date surveyed on
the Improvement Survey)
Please see updated survey on sheet A005 with revision date within (1) year of permit
submittal.
9. Lot area on survey is 2948 SF. Please fix (In reference to stated total lot area on A006
Existing Site Plan)
The Total Lot Area stated on A006 Existing Site Plan has been revised to 2,948 SF to
match the survey.
10. Different from page A006. Please correct (In reference to stated total lot area on A007
Proposed Site Plan)
The Total Lot Area and Area Within Setbacks stated on A007 Proposed Site Plan has
been revised to match the numbers stated on A006.

and area within setbacks on A007 Proposed Site Plan)
The Total Lot Area and Area Within Setbacks stated on A007 Proposed Site Plan has
been revised to match the numbers stated on A006.
12. Table says 490 sf. Please fix. (In reference to the Proposed Floor Area Calculations
table on A009 FAR - Proposed)
The Proposed Upper Level Floor Area Calculations table on A009 FAR - Proposed has
been revised to match the stated area on the adjacent floor plans. The Total Proposed
Floor Area has been revised accordingly.
13. Does not match table or previous pages. (In reference to upper level floor area shown on
the Upper Level Plan on A102 Proposed Plans)
The Upper Level Floor Area on the Upper Level Plan on A102 Proposed Plans has been
revised to the accurate area of 494 SF, matching the tables and previous pages.
14. Mechanical Equipment must be screened if visible from the street. Sec. 26.575.020
(e)(5)(n)
The drawings have been revised to include a mechanical equipment screen, please refer
to the Main Level Plan on A102 Proposed Plans and to the West Elevation on A201 East
& West Elevations.
15. Please provide approval documents that the City was party to showing this exemption
for height. (In reference to the note called out on A201 & A202)
The note on A201 & A202 has been removed. Please refer to the revised Section
4/A301 on sheet A301 as well as the revised Height Over Topo Elevation on sheet A004
showing the proposed bldg height measurement taken from the ground to the midpoint
between the eave and ridge per City of Aspen Municipal Code Chapter 26.575 Figure
18.
