Dear Wyatt,
We are writing this letter as a formal variance request for a proposed drywell system located at
309 Oak Lane, Aspen, Colorado.
The variance process is described in the City of Aspen Municipal under section 29.01.070—
Variances. The process is described and addressed below.
- 29.01.070(a)—The City Engineer may grant variances to the Engineering standards.
Variances are deviations from the terms of this Chapter which would bot be contrary to
the public interest.
We are submitting this variance request for review from the City.
- 29.01.070(b)—In order to authorize a variance from the Engineering standards or
construction management regulations, the following standards shall be met:
o (1)—There exist practical difficulties and unnecessary hardships inconsistent with
the purpose and intent of the Engineering standards.
The project consists of a structure with a footprint that takes up a large portion of
the property. The existing and proposed conditions will not allow for the drywell
to be both 10'off of the property line and 10'off of the foundation.
o (2)—The issuance of a variance shall not compromise the safety of a site or
structure.
The issuance of the variance will not compromise the safety of the site or
structure. The drywell is located as far from the structure as possible while
remaining within the property lines.
- 29.01.070(c)—Requests for variances from the standards, policies or submittal
requirements of this document shall be submitted in writing with appropriate
documentation and justification to the City Engineer. An application for a variance from
the Engineering standards shall include, at a minimum, the following information:
o (1)—The criteria from which the applicant seeks a variance
We request a variance from the URMP's distance requirements from the property
line.

o (2)—A written justification outlining why the criterion cannot be met.
The size of the proposed structure does not allow for the distance requirements to
be met. Site size and grades do not allow for an at grade solution to be utilized.
o (3)An alternate criteria or standard that is proposed to comply with the intent of
the criteria from which the variance is sought.
We have located the drywell as far from the structure as possible while keeping it
within the property line. The drywell is located 10 ft from northwest building face,
9 ft from the sumped entrance, 6 in from the property line, and 9.5 ft from the
curb &gutter along Ajax Ave.
o (4)—Supporting documentation, including necessary calculations, etc.
Please see submitted plans.
o (5)—An explanation of any potential adverse impacts of the proposed variance to
adjacent landowners.
No adverse impacts are expected at this time. Runoff making it to the ROW has
been reduced with this development.
o (6)—An analysis of the variance request must be signed and stamped by a
professional engineer licensed in the State of Colorado.
