Dear Owner of 112 Falcon,
The DRB has reviewed and approved the attached proposal for installation of a generator at 112
Falcon Lane.
Also attached is a resolution regarding generator installations in FiveTrees that will be adopted at
the next FiveTrees Metro District Board meeting.The generator installation at 112 Falcon is
approved subject to all the conditions set forth in the resolution.

RESOLUTION NO.2022-002
RESOLUTION ADOPTING REQUIREMENTS FOR GENERATOR
INSTALLATIONS WITHIN THE FIVETREES METROPOLITAN DISTRICT
WHEREAS,the District Board of Directors (“Board”)wishes to set forth a policy
for the installation of generators within the FiveTrees Metropolitan District;
WHEREAS,the Board may adopt,amend,and enforce bylaws and rules and
regulations to carry on the business,objects and affairs of the District;and,
WHEREAS,the District,as successor and assign of the Declarant,has the
authority as set forth in the Master Declaration of Covenants,Conditions and Restrictions
for Moore Family PTJD,to promote and protect the value,desirability and attractiveness
of the property within the District and the Homeowners Association;and
WHEREAS,the Board adopts this Resolution to provide guidelines to residents
and property owners in FiveTrees regarding the installation and operation of generators
on Lots within the community.
NOW,THEREFORE,BE IT RESOLVED by the Board of Directors of FiveTrees
Metropolitan District,as follows:
1.Generator Installation —Visual Impact
Where residents of the FiveTrees Metro District seek to install generators to maintain
electric service during potential interruptions,the installation of a generator on a property
will be subject to approval by the FiveTrees Design Review Board.The Design Review
Board will review then approve or reject generator installations based on visual and other
impacts to neighboring properties in accordance with the FiveTrees Design Guidelines.
Applicants for generator installations are expected to select locations that minimize or
eliminate visual impact,and approvallrejection based on visual impact will be at the sole
discretion of the Design Review Board.
2.Generator Installation —Noise Impact
Generator installations shall comply with the city of Aspen Noise Ordinance,applicable

Decibel levels will be measured at property lines.Homeowners desiring to install
generators are responsible for any sound baffling or other noise mitigation necessary for
an installed generator to meet the noise requirements per the ordinance.FiveTrees is
within the City of Aspen’s Residential Zone.
3.Generator Installation —Odor Impact
Due to the negative odor impacts of diesel generators,only natural gas or propane gas
generators will be allowed for installation within FiveTrees.
4.Generator Operation Restrictions
Generators are to be operated on a temporary basis only during maintenance on a
property where established electric utilities are not operative or are otherwise not
available and as necessary during electric power outages.Generators will not be
permitted as the primary source of electricity to a property when electric power is
available from the grid.
5.Violations
Violations of this policy will be subject to fines and all other covenant enforcement
remedies available to the FiveTrees District and Homeowners Association.

6.Effective Date.
This Resolution shall take effect and be enforced immediately upon its approval by the
Board.
