The requested variance pertains to the maximum allowable finished grade slope as noted within Section 5.2 on page 40 of the City’s Engineering Design Standards. During the project’s insubstantial amendment process the City was looking for opportunities to reduce the number of proposed boulder walls located throughout the development to include Park C due to a deficit in the number of available boulders. As a result, our office performed grading studies and presented an alternative grading design that eliminated the majority of boulders proposed on Park C. However, the grading revisions required 2:1 slopes in some areas to avoid disturbing areas outside the platted AVLT slope grading and maintenance easement. This redesign was presented to the City and accepted during the insubstantial amendment process. In addition, it should be mentioned that the Parks department supported the redesign as it provided additional design opportunities should the parcel be developed as a Park in the future. The areas of 2:1 slope includes temporary and permanent erosion control measures to minimize the risk of erosion and sediment transport. These measures include erosion control blankets, temporary irrigation as well as landscaping ground cover. Given the requests by the City to reduce the number of boulder walls and interest of City Parks to minimize the overall disturbance on Park C, which ultimately provides them with the utmost flexibility with any future design efforts should the land be developed as a park, we believe that a variance to allow 2:1 slopes is both reasonable and necessary. The issuance of a permit based on construction documents and other data shall not prevent the City of Aspen from requiring the correction of errors in the construction documents and other data.
