Grueter, Pitkin County, CO RESOLUTION 9124' SERIES OF 2025 A RESOLUTION OF THE CITY OF ASPEN CITY COUNCIL APPROVING CERTAIN FEE WAIVERS RELATED TO AN AFFORDABLE HOUSING PROJECT AT 205 W. MAIN STREET; LEGALLY DESCRIBED AS: LOT H, LOT I, AND THE EAST 15 FEET OF LOT G, BLOCK 52, CITY AND TOWNSITE OF ASPEN, COUNTY OF PITKIN, STATE OF COLORADO. PARCEL ID: 2735-124-54-003 WHEREAS, the City of Aspen has long supported the development of affordable housing through provisions within the municipal code, including specifically identified fee waivers for deed -restricted affordable housing development; and, WHEREAS, an affordable housing project proposed at 205 W. Main Street was approved by an administrative Notice of Approval, Reception # 706854, December 20, 2024; and, WHEREAS, the ownership of the property at 205 W. Main submitted a request for certain fee waivers related to the building permit of the approved project; and, WHEREAS, city staff evaluated the request per code provisions, department policies, established precedent, and provided recommendations related to the request; and, WHEREAS, by a vote of X to X (X-X) City Council approved Resolution # 124, Series of 2025, granting approval of certain fee waivers; and, WHEREAS, the City Council finds that this Resolution furthers and is necessary for the promotion of public health, safety, and welfare. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN AS FOLLOWS: Section 1: The following fee waivers are approved: 1) Erosion and Sediment Review Fee (related to Construction Mitigation Plan review) 2) Parks Development Fee (per 26.610.090 and 26.610.100) 3) TDM/Air Quality Fee (per 26.610.090 and 26.610.100) 4) Water Utility Investment Charge (per provisions in 25.12.040) 5) Electric Community Investment Fee (per provisions in 25.04.035) Resolution #124, Series of 2025 205 W. Main St, Fee Waiver Request Page 1 of 2 Fees waived pursuant hereto for the Water Utility Investment Charge and Electric Community Investment fee shall be paid to the Utility Department from the City's general housing fund unless otherwise revoked by City Council. Section 2: This resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the resolutions or ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior resolutions or ordinances. Section 3: If any section, subsection, sentence, clause, phrase, or portion of this resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and shall not affect the validity of the remaining portions thereof.
