RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION (HPC) DENYING AN APPLICATION FOR MINOR DEVELOPMENT FOR THE PROPERTY LOCATED AT 300 SOUTH SPRING STREET, LOTS A AND B, BLOCK 105, CITY AND TOWNSITE OF ASPEN, COLORADO RESOLUTION NO. 12, SERIES OF 2008 PARCEL ID: 2737-182-27-001. WHEREAS, the applicant, Snowmass Corporation, represented by Bruce McKinnon, 24398 Highway 82, P. O. Box 620, Basalt, CO 81621, has requested Minor Development, Demolition, and Variance for the property located at 300 South Spring Street, Lots A and B, Block 105, City and Townsite of Aspen, Colorado; and WHEREAS, 300 South Spring Street, Lots A through D, Block 105, was adopted as part of Exhibit A to Aspen City Council Ordinance 48, Series of 2007 as a potential historic resource; and WHEREAS, Section 26.415.025 of the Municipal Code states that "an owner may volunteer to have any proposed work be reviewed by the Historic Preservation Commission pursuant to the procedures and limitations of Chapter 26.415 of the Municipal Code, and if the work is found by HPC to be in conformance with the "City of Aspen Historic Preservation Design Guidelines," an application for building permit shall be issued;" and WHEREAS, the procedure for a Minor Development Review is as follows. Staff reviews the submittal materials and prepares a report that analyzes the project's conformance with the design guidelines and other applicable Land Use Code Sections. This report is transmitted to the HPC with relevant information on the proposed project and a recommendation to continue, approve, disapprove or approve with conditions and the reasons for the recommendation. The HPC reviews the application, the staff analysis report and the evidence presented at the hearing to determine the project's conformance with the City of Aspen Historic Preservation Design Guidelines. The HPC may approve, disapprove, approve with conditions, or continue the application to obtain additional information necessary to make a decision to approve or deny; and WHEREAS, on June 26,2006, the Aspen City Council adopted Ordinance 16, Series of 2006, granting subdivision approval for the property located at 300 South Spring Street; and WHEREAS, on February 13, 2008, the Aspen Historic Preservation Commission adopted Resolution 4, Series of 2008, granting Minor Development approval for changes to the approved addition and an amendment to the Commercial Design Standards; and, WHEREAS, Sara Adams, in her staff report dated June 11 th, 2008, performed an analysis of the application based on the standards, and found that the "City of Aspen Historic Preservation Design Guidelines have not been met in the proposal; and WHEREAS, at a duly noticed public hearing on June 11, 2008, the Historic Preservation Commission considered the application, at which time the Historic Preservation Commission found the application for Minor Development did not meet the "City of Aspen Historic Preservation Design Guidelines" and denied the application by a vote of 4 to 1. 3-4 V +44 .. NOW, THEREFORE, BE IT RESOLVED that HPC hereby denies the application for Minor Development for the property located at 300 South Spring Street, Lots A and B, Block 105, City and Townsite of Aspen, Colorado. Following is a summary of the two separate sections of the Ordinance that explain how owners of property listed on Ordinance No. 48 can move forward with proposed projects. Section 26.415.025.D. The properly owner can submit a proposal and seek staff determination that the work is exempt from delay under Ordinance No. 48 (routine maintenance work for example); or submit a proposal and seek staff determination that the work, while not exempt from Ordinance No. 48, can move forward by voluntarily complying with Staff or HPC review (depending on the scope of work) of the project, or Section 26.415.025.E. The property owner can refuse the option for HPC review and submit a complete building permit or land use application with the intention of triggering a 90 day delay period, during which time City Staff and Council will negotiate for appropriate preservation of the property. After 90 days, if there is no negotiation reached, the building permit will be processed as requested. The Ordinance does not allow a property owner to simultaneously trigger the 90 day negotiation period and voluntarily submit an application for HPC review. Section 26.415.025.D and E require different processes and different approaches to the proposal. Pursuant to Section 26.415.025.D, the HPC is looking specifically at the proposal's compliance with the Historic Design Guidelines. The 90 day negotiation period involves conversations with staff, LIPC and City Council regarding the nature of the potential historic resource, the proposal and incentives for preservation. The Hannah Dustin land use application submitted on April 1,2008 voluntarily requested HPC review to remove the existing exterior stairway and replace it with a new design. At .. the applicant's request, the proposal was presented to LIPC during a noticed public hearing on June 11, 2008 and processed according to Section 26.415.025.D "[aln owner may volunteer to have any proposed work be reviewed by the [HPC] pursuant to the procedures and limitations of Chapter 26.415 of the Municipal Code, and if the work is found to be in conformance with the "City of Aspen Historic Preservation Guidelines," an application for building permit shall be issued." HPC found that the Guidelines were not met and voted against the proposal. Now that the HPC Land Use application has been evaluated, the property owner has two choices: maintain the existing stairway in its current design, or submit a complete building permit to trigger the 90 day negotiation period with City Council. We hope that additional consideration is given to HPC's determination regarding the importance of the stairway to the Hannah Dustin building. Both Staff and HPC believe that the addition, without the stairway demolition, is a successful project that balances the goals of the community and the property owner. The applicant must submit a complete building permit for the new stairway and a letter acknowledging an understanding of the process to commence the 90 day negotiation period pursuant to Section 26.415.025.E. Galena Street Aspen, CO 81611 Re: Hannah Dustin Stairway Modification/90 day waiting period Dear Sara: In connection with the Hannah Dustin stairway modification application, it is our expectation that the 90 day negotiation period began 1 April 2008, with the submittal of the application and accompanying acknowledgement of the requirements of Ordinance 48. Based on this, the negotiation period would end on 1 July 2008, unless a 30-day extension is approved by the City Council. The basis for this expectation is specifically found in reference to City of Aspen Land Use Code Section 26.415.025(E), Ninety-Day Negotiation Period. This section clearly states that as follows: " For those properties identified on the List of Potential Historic Properties, building permits and land use applications for alterations, demolition, or other similar development activity that substantially alters the Potential Historic Resource shall be accepted by the Community Development Department." We acknowledge that this structure is on the above-referenced list; an application for an alteration to the structure was duly prepared and accepted by the Community Development Department on 1 April 2008. Moreover, the section continues: "Only complete land use applications, as determined by the Community Development Director, shall be accepted. A letter from the properly owner indicating an understanding of this ninety-day negotiation period shall accompany the building permit or land use application." The land use application was accepted, deemed complete by the community development director, and a hearing date was assigned to the application. Ms. Sara Adams, ~ervation Planner ~ City of Aspen Community Development Department 24 June 2008 Page 2 < Attached as part of the application was the requisite letter indicating an understanding of the ninety-day negotiation period. Moreover, it further continues: " Upon acceptance, the building permit or land use application may be reviewed, but shall not be issued, for a period of ninety days to allow for a period of negotiation regarding the preservation of the Resource. This period may be extended an additional thirty days upon a resolution adopted by a majority of the Council." The land use application was indeed reviewed by the Historic Preservation Commission, although no overtures toward a negotiation have been initiated by the City. The Land Use Code section then goes on to describe several actions pursuant to negotiation that may occur during this ninety-day period. However, the onus for action is placed upon the Community Development Director or City Council, and not on the properly owner, for initiating these negotiating activities. The Code section concludes: " If, upon the passage of 90 days or any extension thereof, the City and the property owner have failed to reach a mutually acceptable agreement affected building permits shall be reviewed and shall be issued upon compliance with all applicable building codes. Affected land use applications shall be reviewed and shall be issued a Development Order upon compliance with all applicable provisions of the City of Aspen Land Use Code. The City Council, at its sole discretion, may choose to terminate negotiation at any time and allow the permit or land use application to be reviewed." The Owners believe that they have now complied with all requirements of the Land Use Code for either the issuance of a Development Order or direct permission to tender a building permit application for the requested stairway changes. Discussion at the Historic Preservation Commission focused on preserving the historic stairway for a building not yet fully deemed to be historic irrespective of the design implications. i*1 f'l Ms. Sara Adams, Preservation Planner City of Aspen Community Development Department 24 June 2008 Page 3 Furthermore, one member of the commission clearly stated that they believed the stairway modification to be an improvement upon the current condition. We would like a formal response that our client may tender a building permit application for the requested stairway modification. Failing that, we would request a formal response as to what aspects of the above referenced code section were not fully complied with in the application process. Although this response may be the subject of an appeal by the applicant, we are also formally requesting that a 90-day negotiation period for this property at 300 South Spring Street be initiated immediately. The letter dated April 1,2008, included in the application to HPC for minor development, refers to Section 26.415.025.E of Ordinance #48 which requires acknowledgement of the ninety day negotiation period; however, this section is not applicable to the application at this point. By voluntarily applying to HPC for review o f the proposed project, pursuant to Section 26.415.025.D, the project avoids the ninety-day negotiation period at Council. If HPC denies the application, then the property owner may direct staff to begin the 90 day negotiation period with City Council. The building was designed by the local firm of George Heneghan and Dan Gale, who had previous experience as architects within Benedict's office. The firm completed a number of residences in Aspen and Snowmass. One of their other noteworthy designs is the Aspen Chapel. The Hannah Dustin Building received Council approval on June 26. 2006 to construct an addition that includes new net leasable space, two free market units, and three affordable housing units. It is not a designated landmark. but was adopted as part of Exhibit A to Ordinance #48 Series of 2007 as a potential historic resource. Therefore, amendments are subject to review by the Historic Preservation Commission (HPC). Pursuant to Ordinance #48, the applicant elected to apply to HPC for Minor Development Review to enclose and reconfigure an existing stairway. The other option for the applicant is to enter a negotiation with City Council regarding voluntary landmark designation. On February 13, 2008, HPC adopted Resolution number 4, which granted an amendment to their previous Commercial Design Review along with HPC Minor Development for changes to the addition. There were no changes to the existing building in the approved plans at that time. The applicant requests HPC approval for a Minor Development application to reconfigure the existing stairway on the primary west elevation by rotating it 90 degrees and reconstructing a new enclosed stairway. Staff finds that the proposal adversely compromises and obscures the existing composition of the primary fava(le of this potential landmark. Staff finds that Design Guidelines 1.9,2.1, and 6.1 arenotmet. 1.9 Maintain the established progression of public-to-private spaces when considering a rehabilitation project. 1 This includes a sequence of experiences, beginning with the "public" sidewalk, proceeding along a "semi-public' walkway, to a "semi-private" porch or entry feature and ending in the "private" spaces beyond. u Provide a walkway running perpendicular from the street to the front entry. Meandering walkways are discouraged, except where it is needed to avoid a tree. Use paving materials that are similar to those used historically for the building style. Concrete, wood or sandstone may be appropriate for certain building styles. 1 Preserve original building materials. Do not remove siding that is in good condition or that can be repaired in place. Only remove siding which is deteriorated and must be replaced. Masonry features that define the overall historic character, such as walls, cornices, pediments, steps and foundations, should be preserved. 3 Avoid rebuilding a major portion of an exterior wall that could be repaired. Reconstruction may result in a building which no longer retains its historic integrity. u Removing a damaged feature when it can be repaired is inappropriate. Preserve significant architectural features. Repair only those features that are deteriorated. Patch, piece-in, splice, consolidate or otherwise upgrade the existing material, using recognized preservation methods whenever possible. u Isolated areas of damage may be stabilized or fixed, using consolidants. Epoxies and resins may be considered for wood repair and special masonry repair components also may be used. u Removing a damaged feature when it can be repaired is inappropriate. The proposed stair enclosure is compatible with the approved addition to the north because it replicates the simple boxy style and materiality of the addition; however staff is concerned that the proposed stair combined with the approved addition begins to overwhelm and obscure the existing architecture with contemporary mass. Staff finds that introducing more mass. as opposed to a design that relates interior and exterior spaces and is consistent with the original building, is inappropriate. Guideline 10.3 and 10.4 are met in the contemporary proposal, but Guideline 10.10 is not met. The proposed stair enclosure will obscure significant architectural features. The applicant explains that the purpose of the enclosure is to protect the stairway from inclement conditions and to provide visible access of the stairway from the street. It appears that the commercial spaces on the second and third floors can be accessed from the protected interior courtyard during inclement weather. Furthermore, moving the entrance to the stairway and enclosing it eliminates the interaction of the pedestrian and the architecture beneath the suspended walkways and the experience of blurred interior and exterior spaces. Staff 4 U L C C C o N .. recommends that LIPC deny the request to enclose and reconfigure the stairs because they are an original character defining feature integral to the architecture, and the Design Guidelines are not met. 10.3 Design a new addition such that one's ability to interpret the historic character of the primary building is maintained. u A new addition that creates an appearance inconsistent with the historic character of the primary building is inappropriate. u An addition that seeks to imply an earlier period than that of the primary building also is inappropriate. 2 An addition that seeks to imply an inaccurate variation of the primary building's historic style should be avoided. 2 An addition that covers historically significant features is inappropriate. 10.4 Design a new addition to be recognized as a product of its own time. u An addition should be made distinguishable from the historic building, while also remaining visually compatible with these earlier features. u A change in setbacks of the addition from the historic building, a subtle change in material or a differentiation between historic, and more current styles are all techniques that may be considered to help define a change from old to new construction. 10.10 Design an addition to a historic structure such that it will not destroy or obscure historically important architectural features. u For example, loss or alteration of architectural details, cornices and eavelines should be avoided. The approved addition comprised three levels above grade and a sub-grade employee unit. It is to be dominantly clad in brown horizontal panels of "paperstone," a sustainable product made from resin bonded post consumer recycled paper. From discussions with long term tenants of the existing Hannah Dustin Bldg. and our own observations, it has become apparent that the existing exterior stairway is unsafe in inclement conditions due to its unprotected exposure to weather. It is rarely used, even in periods of fair weather. This existing stairway is located immediately adjacent to the approved elevator component of the new addition and is traversed in an east-west direction on open wood treads. A stairway in that general location is required by code. In its present configuration, however, building occupants and visitors are required to go around the back of the stairs from the Spring Street sidewalk for stairway access. The proposed re-configuration would provide direct and visible access from the sidewalk. To establish safe and protected use of this required stairway the applicant proposes to reconfigure the stairway in its present location by turning it 90 degrees, creating protection and cover, and integrating it into both the new addition and the existing Hannah Dustin Building. The design of the proposed stairway is integrated by primary material and geometry into the street fagade (west elevation) of the approved addition. The design also integrates the rail design of the existing building into its exterior character, resulting in a blended juncture of the two already compatible exterior envelopes. The approved addition comprised three levels above grade and a sub-grade employee unit. It is to be dominantly clad in brown horizontal panels of "paperstone," a sustainable product made from resin bonded post consumer recycled paper. From discussions with long term tenants of the existing Hannah Dustin Bldg. and our own observations, it has become apparent that the existing exterior stairway is unsafe in inclement conditions due to its unprotected exposure to weather. It is rarely used, even in periods of fair weather. This existing stairway is located immediately adjacent to the approved elevator component of the new addition and is traversed in an east-west direction on open wood treads. A stairway in that general location is required by code. In its present configuration, however, building occupants and visitors are required to go around the back of the stairs from the Spring Street sidewalk for stairway access. The proposed re-configuration would provide direct and visible access from the sidewalk. To establish safe and protected use of this required stairway the applicant proposes to reconfigure the stairway in its present location by turning it 90 degrees, creating protection and cover, and integrating it into both the new addition and the existing Hannah Dustin Building. The design of the proposed stairway is integrated by primary material and geometry into the street fagade (west elevation) of the approved addition. The design also integrates the rail design of the existing building into its exterior character, resulting in a blended juncture of the two already compatible exterior envelopes. CITY OF ASPEN COMMUNITY DEVELOPMENT DEPARTMENT Agreement for Pavment of Citv of Aspen Development Application Fees CITY OF ASPEN (hereinafter CITY) and Snowmass Corporation (hereinafter APPLICANT) AGREE AS FOLLOWS: 1. APPLICANT has submitted to CITY an application for an Exterior Stairway Modification to the Hannah Dustin Building at 300 S. Spring Street (hereinafter, THE PROJECT). 2. APPLICANT understands and agrees that the City of Aspen Ordinance No. 57 (Series of 2000) establishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. 3. A PPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it is not possible at this tilne to ascertain the full extent Of ille Costs involved in processing the application. - - APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis. APPLICANT agrees additional costs may accrue following their hearings and/or approvals. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty of recovering its full costs to process APPLICANT'S application. 4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete processing or present sufficient information to the Planning Commission and/or City Council to enable the Planning Commission and/or City Council to make legally required findings for project consideration, unless current billings are paid in full prior to decision. 5, Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the amount of $ 735.00 which is for -1 hours of Community Development staff time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse the CITY for the processing of the application mentioned above, including post approval review at a rate of $235.00 per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing, and in no case will building permits be issued until all costs associated with case processing have been paid.
