Galena St., Aspen, CO 81611 —Authorization for Release of Drawing Files In order to assist in developing documents for alterations which may occur at Monkarsh Residence 626 S. Galena St. located in Aspen, Colorado, Rowland+Broughton Architecture and Urban Design, Inc. ("R+B") hereby authorizes Lynni Hutton Inc. to reference a copy of the following drawings: Galena Residence A4.6, A4.12 issued on 06.22.2020 as part of the project documentation. These drawings are furnished under the following conditions: 1. These drawings are not represented as sufficient to construct future work and shall not be used other than as a reference by the parties responsible for such future work. 2. These drawings as transferred are based on the original design and do not include any modifications, additions or corrections made during the construction process. R+B is not responsible for any costs, losses or damages caused by reliance on the documents for future work, as they are not record as-builts indicating changes made during construction. 3. R+B shall not be responsible for any future work in the design or execution of which these drawings have been or are referred to, unless specifically contracted for such work under an agreement separate from this release. 4. These drawings are instruments of service of R+B, who shall be deemed the author of the drawings, data and information, and shall retain all common law, statutory law and other rights, including copyrights. 5. Use of these drawings and of any material created or derived from them, in whole or in part, for any purpose other than that described above is expressly prohibited. 6. To the fullest extent permitted by law, Lynni Hutton Inc. agrees to indemnify and hold R+B harmless from damage, liability or cost, including reasonable attorney's fees and costs of defense, arising from any use of these drawings without the prior written consent of R+B. 7. Under no circumstances shall transfer of these drawings be deemed a sale by R+B. 8. R+B makes no warranties, either expressed or implied, of merchantability and fitness for any particular purpose. 9. R+B makes no warranties, either expressed or implied, that the drawings contained in these files accurately represent the actual conditions.
