HomeMy WebLinkAboutresolution.council.160-25RESOLUTION # 160 (Series of 2025) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, APPROVING THE STAFF, WORKING TOGETHER WITH APCHA, TO IMPLEMENT THE FOLLOWING LOTTERY PRIORITIES, RESERVATIONS OF RIGHTS AND RELATED PROGRAMS FOR THE LUMBERYARD AFFORDABLE HOUSING DEVELOPMENT. V�►THEREAS, the Aspen City Council (the "Council") has approved the design and received the necessary land use entitlements to construct the Lumberyard affordable housing development ("the Project"), a large-scale multi -phase affordable housing complex, to be built on City owned property; and WHEREAS, the Council finds it necessary, and in the public interests, to establish a rental selection system that recognizes community priorities; and WHEREAS, Council has discussed details of the project elements included below at previous work sessions and provided staff with direction for offering certain levels of priority for qualifying applicants at the Project; and WHEREAS, Council finds that it is appropriate and in the best interests of the community to direct staff to develop and set forth in the applicable deed restrictions priorities for the selection of tenants at the Proi ect which are substantially similar to APCHA's list of priorities as follows: ency Worker Priorit The lottery priority for qualifying Emergency Workers defined in the 2025 APCHA Regulations shall apply to the Lumberyard affordable housing development. This priority will apply to initial leasing and subsequent unit turnover and will be incorporated into the deed restrictions for the project. Future amendments to the Emergency Worker priority within the APCHA Regulations shall automatically apply to the Lumberyard affordable housing development. Employment Location Priorit A lottery priority shall be granted to qualifying applicants employed within the Aspen Urban Growth Boundary. This priority will apply to initial leasing and subsequent unit turnover and will be incorporated into the deed restrictions for the prof ect. Employer Partnership Pro P) Priorit A lottery priority shall be granted to qualifying, verified participants of the City of Aspen Employer Partnership Program (EPP). This priority will apply to initial leasing and subsequent unit turnover and will be incorporated into the deed restrictions for the prof ect. EPP program details, terms, conditions and fees shall be Further defined and included in future EPP agreements between the City of Aspen and participating area employers. The number of units available for EPP priority program participants shall be capped at a total of 50 units with no more than 25 units in any building at the Lumberyard affordable housing development. Rightsizing If a rightsizing lottery priority for rental units is added to the APCHA Regulations in the future, that priority shall automatically apply to the Lumberyard affordable housing development. Displaced Occupants If a priority is added to the APCHA Regulations in the future for qualifying applicants who have been displaced by government action related to affordable housing development or redevelopment, that priority shall automatically apply to the Lumberyard affordable housing development. Mo]Arta li Disabled A licant Pri for �e A Units The lottery priority for Type A units for qualifying Mobility Disabled Applicants defined in the 2025 APCHA Regulations shall apply to the Lumberyard affordable housing development. This priority will apply to initial leasing and subsequent unit turnover for Type A units and will be incorporated into the deed restrictions for the project. Future amendments shall automatically apply to the Lumberyard affordable housing development. Hierarchy of Priorities The Emergency Worker priority provision as written in the 2025 APCHA Regulations states that qualified Emergency Workers will be placed at the "top of the priority list" for rental units. The Mobility Disabled Applicant priority provision as written in the 2025 APCHA Regulations provides for a "first priority" in renting a Type A unit. While defined as such in the APCHA Regulations, those priorities shall be of one tier above all other priorities, and all other priorities shall be settled via applicable lottery protocols per the APCHA Regulations at the time of leasing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, That the City Council of the City of Aspen hereby approves the City Manager to direct staff, working together with APCHA, to move forward with implementation of the conditions set forth above.
