The applicant is requesting approval of a total of ninety-three (93) days throughout the year.Figure 1. Location of Maroon Creek ClubStaff Recommendation:Staff recommends City Council approve the applicant’s request for a ninety-three (93) day temporary use approval. Additionally, staff is recommending annual recurrences be granted for five (5) years.
Request of City Council:The applicant is requesting Temporary Use approval related to various temporary structures (tents)in accordance with Chapter 26.450 of the Land Use Code.The Code allows City Council to grant temporary use approval for up to 180 consecutive days within a calendar year. The applicant is also requesting City Council grant a minimum of five (5) annual recurrences, and ideally would like to receive the maximum ten (10) annual recurrences.City Council is the final review authority.
Location/Background:The Maroon Creek Club (MCC) was approved as a Planned Development (PD) by Pitkin County in 1993 and was later annexed into the City of Aspen. The PD – which remains in effect, approved residential and golf course development consisting of single-family homes, multi-family homes, employee housing, golf course facilities and the golf course. The golf club development included an 18-hole course, a driving range, a practice green, a snack bar, a golf cart storage and maintenance building, parking, and additional commercial square footage for the Grand Champions Club.
Current request: MCC hosts events for its members through the year, and many of these events require a temporary tent be erected in support of the special event. These events include the Member Holiday Party in December, The Member Golf Tournament, a Summer Kickoff Party, the ThinkBig Weekend, and a 4th of July Party. All told, the club requests 83 days of planned tent use and 10 additional days to accommodate potential additional days, as needed. As the code exempts the first 14 days from mitigation, mitigation calculations are based on 79 days of tent use. The tents are proposed for four locations on the club property: The main lawn, the patio adjacent to the main dining room, the pool area, and the driving range. See Figure 2 below for a map of the proposed locations.
The proposed tents range in size from 10 feet x 20 feet to 60 feet x 115 feet. However, 63 days of the 93 total days requested will utilize a 20 feet x 20 feet tent.
Staff Findings:Staff has reviewed the applicant’s request against the relevant review criteria and finds the following:
The proposed temporary use structures at the Maroon Creek Club are consistent with the intended purpose of the planned development – to facilitate a golf club as the primary use. The proposed tents would enhance the ability of the club to put on special events for its members and their guests.
The proposed location of the tents would have a minimal impact on the surrounding area. While most potential impact involves the large tents proposed for the driving range during the ThinkBig event in September, the impact, if any, will be temporary. The other tents are located adjacent to the club building and will likely not be visible beyond the immediate neighbors – who are primarily members of the club. Given the limited visual impact as seen from the surrounding area, and the temporary nature of any impact, staff finds the proposal consistent with review criteria. (See Exhibit A for more detail on review criteria.)
Growth Management: The applicant has requested approval for ninety-three days (93) days in the upcoming year. The applicant has requested eighty-three (83) days for known events and an additional ten (10) days to accommodate further needs as they might arise. The code exempts the first fourteen (14) days of use from GMQS. The additional ten days the applicant is seeking approval for has been calculated based on the tent with the longest duration of proposed use. In total, the growth management mitigation for the tents is $10,278.91, for 2018-2019. Future mitigation will be calculated using the cash-in-lieu figures in effect at the time of yearly renewal. Payment of yearly mitigation will be required prior to the issuance of the first permit in the renewal year. (See Exhibit B for mitigation calculation)
Staff Recommendation:Staff recommends approval of the applicant’s temporary use request with five (5) years of automatic reoccurrence. After this five year period, an additional five(5) years could be approved annually with an administrative review. This is consistent with past temporary tent approvals on other properties.
Proposed motion:“I move to approve Resolution No. 64, Series of 2018 to allow the erection of varioustemporary tents on site at the Maroon Creek Club for 93 days in each calendar year from 2018-2023.”
