BACKGROUND AND SUMMARY: The Maroon Creek Club Subdivision PD was approved by the Pitkin County Board of County Commissioners in 1993. The City of Aspen annexed the subdivision in 1996 and the previously approved PD carried over. The PD includes forty-three (43) single family lots, thirty-seven (37) townhomes, thirty-nine (39) employee housing units, a Grand Champions Club (Clubhouse), a golf course, and various trail improvements. A number of PD amendments have been approved since the subdivision’s annexation. The Applicant is requesting an Insubstantial PD Amendment and a Commercial Design Review for the Maroon Creek Club Clubhouse for changes to the pool area. The Applicant proposes a renovation to the Clubhouse Pool that includes demolishing the existing pool, installing a different shaped pool, adding a hot tub, a water slide, and a zero edge children’s play pool. There are also proposed changes to the pool deck surface, including: several permanently installed sunshades, a concrete and wood bridge over the pool, and a pool safety fence. The proposed alterations are illustrated in Exhibit A. STAFF EVALUATION: Land Use Code Section 26.445.110.A regulates Insubstantial Amendments to an approved Planned Development as authorized by the Community Development Director. The Director finds the proposed exterior alterations satisfy the review criteria (Exhibit C) for an Insubstantial Planned Development Amendment as the proposed alterations are minor in nature and do not change the character, use, or massing of the Clubhouse. Land Use Code Section 26.412.090 regulates Insubstantial Amendments to an approved Commercial Design Review, as authorized by the Community Development Director. The Director finds that the proposed alterations satisfy the relevant Commercial Design Guidelines and review criteria (Exhibit D). The proposed materials and design are consistent with the existing design and materials. REFERRAL AGENCIES: The Land Use Case was referred out to the Engineering and Parks Departments. The Engineering Department had no comments on the proposed amendment. However, the Engineering Department did have permit concerns that were sent to the applicant. The Parks Department had additional comments that were sent to the applicant to be addressed at permit submittal. The City Forester has signed off on the tree permit for this request and had no comments on the proposed amendment. DECISION: The Community Development Director finds the administrative application for an Insubstantial PD Amendment and an Insubstantial Amendment to an approved Commercial Decision Review as noted above, to be consistent with the applicable review criteria and thereby, APPROVES the request with the following Conditions of Approval. 1. The request includes an addition in the site’s deck area. The applicant must determine that they have a proper amount of floor area to include these improvements. 2. The permanently installed sunshades, including the sunshades and the posts which they are attached, must be fully removable, or retractable.
