Amendments to an approved Project Review or to an approved Detailed Review shall be reviewed according to the standards and procedures outline below. Amendments to Planned Unit Development and Specially Planned Area approvals (pre-Ordinance 36, 2013, approvals) shall also proceed according to the standards and procedures outline below and the Community Development Director shall determine the type of procedure most-applicable to the requested amendment. a) Insubstantial Amendments. An insubstantial amendment to an approved Project Review or an approved Detailed Review may be authorized by the Community Development Director. An insubstantial amendment shall meet the following criteria: 1. The request does not change the use or character of the development. Staff Response: This amendment will replace existing staircases and screen the new stairs from the elements. The replacement of this necessary egress for building code compliance and resident safety does not change the use nor character of the development. Staff finds this criterion met. 2. The request is consistent with the conditions and representations in the project's original approval, or otherwise represents an insubstantial change. Staff Response: This amendment is consistent with the approvals that allowed the development of the multi-family residential buildings, and the stairs will be replaced in the same location represented in the original approvals. The shed roofs that will be constructed over the stairs will match the roof forms and materiality of the existing development. The screening will be consistent throughout the entire project and is insubstantial when considering the overall scale of the development. Staff finds this criterion is met. 3. The request does not require granting a variation from the project's allowed use(s) and does not request an increase in the allowed height or floor area. Staff Response: The approved maximum building height in Truscott Phase II is 41’ 4 1/2 “. The staircase roof assemblies of all four stairs are less than the maximum height. Exterior stairs do not count towards floor area unless the element exceeds 15% of the property’s allowed floor area. The exterior stairs are being replaced to maintain safe egress for the residents. Neither the footprint of the egress stairs, nor the area of the treads or landings are anticipated to increase as a result of the project. Community Development Director may approve exceptions to floor area allowances for building code compliance Section 23.575.110 (k) should the Exhibit B 10-70 Truscott Place Review Criteria Page 2 of 2 treads or landings need to be expanded to comply with the International Building Code, as adopted, at time of building permit. Staff finds these criteria met. 4. Any proposed changes to the approved dimensional requirements are limited to a technical nature, respond to a design parameter that could not have been foreseen during the Project Review approval, are within dimensional tolerances stated in the Project Review, or otherwise represents an insubstantial change. Staff Response: This amendment is consistent with the allowances included in the original approval. Staff finds this criterion is met. 5. An applicant may not apply for Detailed Review if an amendment is pending. Staff Response: There is no Detail Review pending. The residential use of the property will be unchanged. Staff finds this criterion is met.
