Galena Aspen CO 81611 Re: Villa of Aspen Insubstantial PUD Application Parcel ID # 273512313801 Dear Jim: The Villa of Aspen Townhouse Association, located at 100 N. 8th Street, Aspen CO 81611 together with six owners of units, # 3, #8, #9, # 10, #31 and # 32 hereby authorizes the City of Aspen to prepare for approval an insubstantial amendment of the complex’s PD. This application mirrors the last Insubstantial Amendment in 2011. The Home Owners Association has given permission for the improvements to each of the units in the First Amendment to the Declaration (Book 592, pp.39-40 May 5, 1989). The purpose is to have the PD reflect improvements proposed to unit # 31 to enclose the front landing and additionally pre-approve the same improvement for units, # 3, #8, #9, ,#10 and # 32. Thirty other units have already made this conversion, as depicted in the Third Amendment to the Plat. Galena Aspen CO 81611 Re: Villa of Aspen Insubstantial PUD Application – description of the proposal Dear Mr. Pomeroy: The Villa of Aspen Townhouse Association, located at 100 N. 8th Street, Aspen CO 81611 submits this application for a Fourth Amendment to the Plat of the Villa of Aspen Townhouses. The purpose of this application is to seek approval for the remaining six units to enclose their front landings. Those units are # 3, # 8, # 9,# 10, # 31 and # 32. That is, by prior authorization for all units, set forth in the First Amendment to the Declaration (Book 592, pp.39-40, !989). The first PD amendment was approved consistent with that change. (Book4, page 296, 1989). To date, 30 out of 36 townhouse units have already enclosed front landings and incorporated that space into the Unit. This Insubstantial Amendment thus conforms with prior approvals by the City. It also pertains to a current remodel of one unit, # 31 that has been approved by the HOA and is in the permit process. The only new construction envisioned by this change is the enclosure of a landing at the front entrance to a townhouse. This is accomplished by moving the front door. Using # 31 as an example, the existing plat (2011) shows the landing: When completed, a portion of the landing will be contained within the Unit, as is the case in adjacent unit # 30, depicted as: 26 The overall footprint remains the same, the change merely coverts a trivial part of the Limited Common Elements associated with that Unit into the square footage of the Unit itself. Briefly, the buildings in the complex have been expanded over the years since the original PUD. A Second Amendment to the Plat was completed in 1997, containing all additions to buildings as of that date. An Insubstantial Amendment was approved in 2008 allowing the addition of decks on certain units. The last Insubstantial Amendment was approved in 2011 to add to the plat additions made since 1997, including those authorized in 2008. This proposed Insubstantial Amendment adds and pre- approves the landing conversion for the remaining six units. Consistent with direction set forth in the Conference Summary (EX. A), the proposed Insubstantial Amendment follows the format of the last one ( EX. B). Since there is essentially no physical development at all of the development associated with this application, the updated PD amendment conforms to all review standards of Section 26.445.100 of the land use code and thus qualifies as an Insubstantial Amendment.
