Hyman Ave. Aspen, CO 81611 970-925-4755 SUBJECT & SITE OF APPROVAL: Insubstantial Planned Development (PD) Amendment at 64 Pitkin Way, Aspen CO 81611 ZONING: Low -Density Residential (R-30) and Planned Development (PD) SUMMARY: The applicant requests an Insubstantial Planned Development (PD) Amendment to the Pitkin Reserve PUD. The amendment will adjust an existing building envelope to include areas of the existing building projecting beyond the current building envelope and to allow for an addition. The building envelope area will not be increased as a result of this amendment, nor will the dimensional allowances, including floor area or height, be increased or reduced as a result of this request. STAFF EVALUATION: The building envelope adjustment will not result in an increase in allowed floor area or height. The use of Lot 2 as a single family home will not be affected by a building envelope adjustment. The new envelope will include areas that are outside the current building envelope as shown in Figure I and the non -conformity will be brought into compliance. The amended plat must be submitted prior to building permit submittal; however, this will result in creating a non -conformity due to the trellis structure projecting beyond the existing depicted in Figure I and Figure 2 and the and proposed building envelope as shown in Exhibit A. Vos Caudill, Pitkin County, CO To satisfy the Applicant request to amend the building envelope, the following condition has been included as a part of this approval: The trellis may remain throughout the natural life of the element. Prior to receiving a Certificate of Occupancy for any building permit, the non -conforming trellis must be removed and any structure, as defined in Section 26.104.100, Definitions, as amended; shall be contained within the amended building envelope. Amending the building envelope is otherwise considered a minor change. The building envelope is above the Green Belt Line. The Green Belt Line was shown in the Amended Plat of the Pitkin Reserve Subdivision (Book 14 Page 92). The Green Belt Line was not shown on the Second Amended Plat (Book 16 Page 15); however, Staff has interpreted that the intent of the establishment of building envelopes was to prevent development from encroaching upon the Rio Grande corridor. The amended building envelope is shown above the Green Belt Line as shown in Exhibit B. There is no net increase in the building envelope area. Staff finds the review criteria for an Insubstantial PD Amendment are met, as described in Exhibit C. DECISION: The Community Development Director finds the Administrative Application for an Insubstantial PD Amendment as noted above and the draft plat depicted in Exhibit A to be consistent with the review criteria (Exhibit C) and thereby, APPROVES the request.
