APPROVAL FOR AN INSUBSTANTIAL PLANNED DEVELOPMENT AMENDMENT TO
ACCOMMODATE A ROUGHLY 214 SQ. FT. FLOOR AREA EXPANSION AT THE PROPERTY
COMMONLY KNOWN AS 81 EXHIBITION LANE, LEGALLY DESCRIBED AS UNIT 15, BLOCK E,
ASPEN HIGHLANDS VILLAGE TOWNHOME RESIDENCES MAROON NEIGHBORHOOD,
ACCORDING TO THE FINAL PLAT THEREOF FILED JANUARY 12, 2000, IN BOOK 52 AT PAGE 26
AS RECEPTION NO. 439493. COUNTY OF PITKIN, STATE OF COLORADO.

SUBJECT & SITE OF APPROVAL:
81 Exhibition Lane is located in the Aspen Highlands Village Planned Development and is zoned Residential Multi-
Family (RMF) with a Planned Development (PD) Overlay. The Aspen Highlands Village PUD was approved by the
Pitkin County Board of County Commissioners (BOCC) in 1997 via Resolution No. 97-167 (Reception No. 422629)
and Resolution No. 98-79 (Reception No. 423268). Aspen Highlands Village PUD was subsequently annexed into
the City in 200 via Ordinance 8-2000 (Reception No. 442835). Ordinance 36-2000 (Reception No. 449207) assigned
City Zoning regulations to the newly annexed area.
81 Exhibition Lane is in Block E of the Aspen Highlands Village Planned Development. The original 1998 Plat (Book
47, Page 7) defined a building envelope for Block E. A subsequent Supplemental Plat in 2000 (Book 52, Page 27)
created the property boundaries for Unit 15, Unit 16, and the Maroon Neighbor Townhome Association (MNTA).
An Insubstantial PD Amendment per Section 26.445.110.A, Insubstantial Amendments is required to approve the
increase in Floor Area. This has been submitted to make the PD approvals consistent with the increase in Floor Area
resulting from the proposed townhome expansion at 81 Exhibition Lane. The Community Development Director may
approve, approve with conditions or deny this request based on criteria found in Exhibit B of this memo.
SUMMARY:
The applicant requests approval to allow for a roughly 214 sq. ft. increase in Floor Area. This increase in Floor Area
will be within the existing building envelope, within the property line, and will be under the maximum allowable
Floor Area for the townhome. According to the Aspen Highlands Village Planned Development Guide (Reception
No. 423274), each townhome is limited to 3,500 sq. ft. of Floor Area. The application states that the existing Floor
Area is 3,150.39 sq. ft. and the proposed will be roughly 3,378.76 sq. ft. This will be confirmed at time of building
permit.
STAFF EVALUATION:
Staff finds the request for a roughly 214 sq. ft. increase in Floor Area for an addition to the existing townhome to
meet the review criteria for an insubstantial PD amendment (Exhibit B). Provided that the applicant has the available
allowable square footage, the increase will be below the maximum allowable square footage for the townhome. The
addition will also be located at the back of the townhome within the building envelope and property line. It appears
that this property will be taking advantage of BOCC Resolution 98-254 (Reception No. 434844) which allows for
townhomes to exceed allowable floor area by up to 315 sq. ft. so long as that amount of square feet is subtracted from

the 750 sq. ft. garage exemption. All Floor Area calculations will be confirmed at time of building permit by the
appropriate review agency.
DECISION:
The Community Development Director finds the request for an increase of roughly 214 sq. ft. to the Floor
Area at 81 Exhibition Lane consistent with the criteria outlined in Section 26.445.100.A, Insubstantial
amendments (Exhibit A) and thereby approves the request with the following conditions of approval.
1. All Floor Area calculations will be confirmed at time of building permit.
