Address: 96 McSkimming Road Parcel ID: 273-718-104-015 Zone District: R15-B The subject property seeks to redevelop the site with a single-family residence. The proposed design includes a hot tub and permanent outdoor grill between the proposed structure and the street. The applicant is requesting an Administrative Exception to the prohibition of hot tubs, outdoor grills and other similar features established in Section 26.575.020(e)(5) of the Aspen Land Use Code. Exhibit A of the Application includes the following requested elements within a prohibited area:  One outdoor grill  One hot tub The Applicant is requesting relief from the prohibition of these features between a structure and the adjacent street. The Community Development Director may approve an exception to this requirement if it is determined the visual impacts are minimal and that no other reasonable option exists. The applicant has demonstrated that the siting of these features is appropriate given the site-specific constraints. The lot shape is narrow and is a reverse curve lot which limits alternative locations that comply with the code. The property contains steep slopes, and plantings are used to help minimize the visual impact of the features, as viewed from the street. The applicant has provided adequate documentation that no reasonable alternatives exist to locate the hot tub, the visual impacts are minimal, and to the extent practicable, the visual impacts are mitigated with vegetation. The placement of the features as depicted in Exhibit A of the application is approved. This approval does not constitute a site-specific development plan and will not be issued a development order. The approval does not convey a vested right and the approved project is subject to any changes to the Land Use Code prior to building permit submittal.
