Growth Management Affordable Housing Calculation
Section 26.470.090(I) Temporary uses and Structures. The development of a temporary use or
structure shall be exempt from growth management, subject to the provisions of Chapter 26.450,
Temporary and Seasonal Uses. Temporary external airlocks shall only be exempt from the
provisions of this Chapter if compliant with applicable sections of Commercial Design Review –
Chapter 26.412, and approved pursuant to Chapter 26.450 Temporary and Seasonal Uses. Tents,
external airlocks, and similar temporary or seasonal enclosures located on commercial properties
and supporting commercial use shall only be exempt from the provisions of this Chapter,
including affordable housing mitigation requirements, if compliant with applicable sections of
Commercial Design Review – Chapter 26.412, if erected for 14 days or less in a 12-month
period, and approved pursuant to Chapter 26.450 – Temporary and Seasonal Uses. Erection of
these enclosures for longer than 14 days in a 12-month period shall require compliance with
Commercial Design Review – Chapter 26.412, and compliance with the provisions of this
Chapter including affordable housing mitigation. Affordable housing mitigation shall be required
only for the days in excess of 14 in a 12-month period. Cash-in-lieu may be paid by-right. The
mitigation calculation shall include the expected lifespan of a building, which is currently 30
years. For instance, a 500 sq. ft. tent proposed to be up for 21 days shall only require mitigation
for seven (7) days. The calculation would be as follows:
Staff Response: The methodology used in calculating the required Affordable housing
mitigation for the temporary use application combined all locations and tent sizes. The
fourteen-day credit was applied to the Fountain Courtyard, as that is the most commonly used
structure. A total of eighteen (18) days and 3,960 sq. ft. were used to calculate the affordable
housing mitigation required for this tent. The Mountain Plaza and Pool Deck tents were
calculated using the proposed square footage of the tents, and that total was added to the
mitigation required for the Fountain Plaza. The total mitigation shown below is for only
thirty-five (35) days. The applicant has requested approval of a total of forty (40) days, the
location of the additional five (5) days of use have not been indicated. In order to allow the
applicant flexibility, those additional five (5) days of mitigation will be calculated and collected
upon issuance of the tent permits for those events. The affordable housing mitigation fees for
the first 35 days will be due upon issuance of the first tent permit in each calendar year. See
the calculation below.
Methodology:
Fountain Plaza
• 3,960 sq. ft./ 1,000 sq. ft. = 3.96 sq. ft.
• 3.96 sq. ft. x 4.7 FTEs = 18.612 FTEs
• 18.612 FTEs x 65% mitigation rate = 12.0978 FTEs to be mitigated if structures are in
use 100% of the year
• 12.0978 FTEs / 365 days per year = .03314466 daily rate
• .03314466 x 18 days = .5966 FTEs
• .5966 x $223,072 cash-in-lieu rate = $133,085.61
• $133,109.47/30-year lifespan = $4,436.19 due for mitigation of the structure for a period
of 18 days.
Mountain Plaza:
• 900 sq. ft. / 1,000 sq. ft. = .9 sq. ft.
• .9 sq. ft. x 4.7 FTEs = 4.23 FTEs
• 4.23 FTEs x 65% mitigation rate = 2.7495 FTEs to be mitigated if structures are in use
for 100% of the year.
• 2.7495 FTEs / 365 days per year = .00753288 daily rate
• .00753288 x 2 days = .015065753 FTEs
• .015065753 x $223,072 cash-in-lieu rate = $3,360.75
• $3,360.75 / 30-year lifespan = $112.03 due for mitigation of the structure for a period of
2 days.
Pool Deck
• 100 sq. ft. / 1,000 sq. ft. = .1 sq. ft.
• .1 sq. ft. x 4.7 FTEs = .47 FTEs
• .47 FTEs x 65% mitigation rate = .3055 FTEs to be mitigated if structures are in use for
100% of the year.
• .3055 FTEs / 365 days per year = .00083699 daily rate
• .00083699 x 1 day = .00083699 FTEs
• .00083699 x $223,072 cash-in-lieu rate = $186.71
• $186.71 / 30-year lifespan = $6.22 due for mitigation of the structure for a period of 1
day.
