Property: 105 South Mill Street; legally described as Lots G, H and I, Block 80, City and Townsite of Aspen Colorado. PID# 2737-073-29-004. Determination: This 19th day of October 2022, the following alteration has been approved as represented in the land use application. Project Details and Review Criteria The applicant is replacing fenestration on the non-historic addition to a landmark structure in the Commercial Core (CC) Historic District by undertaking the following work as represented in the land use application: • Replace all existing fenestration for the 2nd floor space where a restaurant currently located. The replacement windows are to match the current window size, aesthetic and function to the greatest extent possible. The project qualifies for a Certificate of No Negative Effect according to Section 26.415.070.B of the Municipal Code as it entails alterations to landmark properties and properties within the historic districts, but the work creates no change to the exterior physical appearance of the building. The property is located in the foreground of the Main Street View plane but the proposed exterior alteration does not create an infringement into the view plane nor visible increases the height or mass of the building from the reference points (Section 26.435.050). Based on a review of the applicable Commercial, Lodging and Historic Design Standards and Guidelines (1.22, 1.23, 1.33, 1.34, and 2.14), staff finds the proposed work will not diminish, eliminate or adversely affect the significant historic and/or architectural character of the landmark or the Historic District in which it is located and the design standards and guidelines applicable are met with no additional conditions. _________________________________ Amy Simon, Planning Director Expires 3 years from date of separately issued Development Order.
