NOTICE OF APPROVAL
FOR AN ADMINISTRATIVE GROWTH MANAGEMENT QUOTA SYSTEM REVIEW
FOR A 2023 DEMOLITION ALLOTMENT TO DEMOLISH AN EXISTING SINGLE-
FAMILY STRUCTURE AND REDEVELOP THE SITE WITH A NEW SINGLE-FAMILY
RESIDENCE. THE PROPERTY IS COMMONLY DESCRIBED AS 108 MIDLAND
AVENUE, ASPEN CO 81611, AND LEGALLY DESCRIBED AS LOT 1, FERGUSON
EXEMPTION PLAT, ACCORDING TO THE PLAT THEREOF RECORDED JUNE 1,
1981 IN PLAT BOOK 11 AT PAGE 59 AS RECEPTION NO. 233197, COUNTY OF
PITKIN, STATE OF COLORADO.

SUMMARY:
The applicant has requested an administrative GMQS review for one (1) Demolition Allotment to
fully demolish the existing single-family residence and replace with a new single-family residence.
The subject property is at 108 Midland Ave., with a Parcel ID# of 2737-181-26-110.
STAFF EVALUATION:
An application was submitted by Chris Bendon, the authorized representative of Justin Haynes,
Midland Properties, LLC (the Applicant/manager). A complete application was submitted at
8:29:57.9841556Z MDT. This application was issued a Notice of Denial since Demolition
allotments had been awarded to the first six eligible and complete 2022 applications, and no
2022 allotments remained.
The applicant submitted an Appeal of the Notice of Denial calling into question the Community
Development Directors determination of the order in which applications were considered. Given
the uncertainty and extended timeline in which a resolution of the appeal may be reached for all
affected parties included in the 2022 Demo allotment application process, City Council
considered a settlement agreement, and approved the issuance of a six multi-year allotments
from 2023 via Resolution No. 140 Series of 2022.
The application and property meet the review criteria of Section 26.470.090.C. Given the City
Council approval of the issuance of a Multi-year allotment, this Notice of Approval grants one
Multi-Year Demolition Allotment from 2023 to the subject property. A condition of approval is
included that the project meet all standards and requirements outlined in the Residential
Demolition and Redevelopment Standards in effect at the time the land use application for a

Demolition allotment was submitted. Compliance must be demonstrated prior to building permit
issuance. Initial responses included in the application indicate the Applicant is aware of all
requirements in the RDRS documents, and will comply or seek variations as needed, prior to
permit issuance.
DECISION:
The Community Development Director finds the requested GMQS review for one Multi-
Year (1) Single-Family or Duplex Demolition Allotment as noted above meets the
requirements as described in the Land Use Code Section 26.470. 090.C and hereby
APPROVES the request with the following conditions:
1. All requirements of the Residential Demolition and Redevelopment standards in
place on August 8, 2022, must be met prior to building permit issuance.
2. The building permit submission must include a signed and notarized affidavit the
property owner, or successors, will comply with the requirements of the Building IQ
program.
3. The building permit submission must include a signed and notarized affidavit the
property owner, or successors, will comply with the requirements of the Embodied
Carbon requirement prior to receiving a Certificate of Occupancy.
4. Approval and related vesting are limited to the issuance of a GMQS Demolition
Allotment and Residential Demolition and Redevelopment Standards. The property
is subject to all other requirements of the Land Use and Building Codes in effect at
the time of building permit submission.
