SUBJECT & SITE OF AMENDMENT:
The applicant would like to vacate the existing Condominium Plat from 1989 (Bk 22 Pg 58) and
nullify the associated condominium documents to formally convert the property to a single
ownership to reflect its existing conditions and use. The property is currently a single family use
which is allowed within the Residential Multi-Family (RMF) Zone District. The subject property
is located at 109 E Hyman Avenue, with Parcel IDs of 2735-124-72-800, 2735-124-72-001, and
2735-124-72-002; the property is legally described as listed above.

SUMMARY:
The existing Condominium Plat is located at 109 E Hyman Avenue, a lot that is approximately
6,000 square foot in downtown Aspen. The property is zoned RMF, which allows for single
family, duplex, and multi-family uses. The property contains a legally established single-family
residence that was converted from a duplex in 2015.
The current owners of the property, HBN Family Trust, submitted a building permit in 2015 to
renovate the existing building and combine the two units into a single home. The permit was
reviewed by the Building and Zoning Departments and was approved as compliant with the
requirements for a single-family home. A Certificate of Occupancy (CO) was approved in 2018,
and shows the approval as a single-family home.
Because the property continues to have a condominium regime on the property, separate title
work is required for the property, even though it is a single residential unit. The application to
vacate the Condominium Plat (Book 22 Page 58) and associated documents will memorialize
single ownership of the parcel moving forward. This will simplify requirements from a funding,
refinancing, and chain of title perspective.
The Land Use Code allows for condominiumization to “establish, amend, or vacate separate
ownership interests of a single property in a Condominium or Common Ownership Interest
Community for of ownership to be approved or approved with conditions by the Community
Development Director.”
STAFF EVALUATION:
Staff finds that the request meets the requirements of Plat Vacation allowing for the vacation of
the existing Condominium Plat and all associated documents.
DECISION:
The Community Development Director finds the request for a Plat Vacation as noted above
to meet the requirements as described in the Land Use Code, and APPROVES the request
to vacate existing Condominium Plat recorded at Plat Book 22, Page 58, as Reception
Number 311945 with the Pitkin County Clerk and Recorder.
