HomeMy WebLinkAboutNOA_BldgEnvAdj_Lot7_BarX NOTICE OF APPROVAL FOR AN INSUBSTANTIAL PLANNED DEVELOPMENT (PD) AMENDMENT TO THE BUILDING ENVELOPE CONTAINED ON LOT 7 OF THE STAGE ROAD/DOUBLE BAR X PD/SUBDIVISION Parcel ID: 2735-023-03-007 __________________________________________________________ APPLICANT: Oyster Shores, LLC REPRESENTATIVE: Bill Pollock and Jeff McCollum, Zone 4 Architects SUBJECT & SITE OF THE APPROVAL: Stage Road/Double Bar X PD/Subdivision, Lot 7, involving a change to the recorded building envelope. SUMMARY: The owner of Lot 7 requests a building envelope adjustment to modify the shape of the existing envelope without increasing size. The PD Control Document (recorded as Reception No. 515890) permits Insubstantial Amendments to building envelopes to be reviewed and approved administratively by the Community Development Director. STAFF EVALUATION: Lot 7 has several limitations that make the siting of development a challenge. An Agricultural Conservation Easement and the identified Top of Slope of Maroon Creek create constraints. Most importantly the established Maroon Creek View Plane creates limits on the height of development (below the 30’ generally allowed in the PD) for a significant portion of the property. The proposed, amended building envelope increases the development potential of the lot while respecting these constraints. The existing building envelope is approximately 21,891 square feet. The proposed envelope adjustment shifts a total of 2,784 square feet from two portions at the northeast and southwest corners of the envelope the northwest corner of the envelope. The proposed envelope remains identical in size to the existing envelope. Importantly, the proposed envelope has been approved by the Double Bar X Architectural Review Committee and Homeowner’s Association. Planning Staff has visited the site on two occasions and has had extensive discussions with the applicant’s representative, City of Aspen Parks and Engineering Departments, and the Fire Marshal for the Aspen Fire Department. The conversations have primarily been about providing access to the site, but connected to these discussions were the site constraints inherent to and imposed on the property. The proposed envelope adjustment was referred to both the Parks and Engineering Departments for comment. No concerns were raised with regards to the proposed envelope. Planning Staff finds that the proposed envelope adjustment meets the review criteria. DECISION: Staff finds that the Insubstantial PD Amendment application provided by the Applicant, Oyster Shores, LLC (represented by Zone 4 Architects) meets the applicable criteria and is appropriate for approval.
