Aspen Mini-Storage, Annexation Petition
REQUEST OF COUNCIL: City Council is asked to approve Resolution No. 029, Series
of 2022.
SUMMARY AND BACKGROUND: The Aspen Mini-Storage property, owned by the City
of Aspen and intended for inclusion in the land assemblage that will define the site of the
Lumberyard affordable housing project, is located in unincorporated Pitkin County. When
purchased by the City, this property was planned for eventual annexation into the City of
Aspen.
The process for annexation requires a minimum of four meetings with City Council. This
process, and the proposed outcomes are identical to annexation of the Lumberyard
property 11 years ago.
On January 25, 2022, Council passed Resolution No. 14, Series of 2022. This Resolution
is required by Colorado Revised Statutes to initiate the annexation process by verifying
that the Petition for Annexation and Draft Annexation Plat are in substantial compliance
with C.R.S requirements. It additionally established the date for tonight’s public hearing
and specified the notice requirements for the hearing.
The public hearing tonight asks Council to consider Resolution No. 29, Series of 2022.
The public notice requirements established by state law have been met and affidavits to
this effect have been reviewed by the City Attorney. It is important to note that as part of
these notification requirements, certified, mailed notices have been sent to Pitkin County,
the Aspen Unified School District, and other special districts to which the property is
subject.
This Resolution, if approved, will show Council’s confirmation that the Colorado Revised
Statutes requirements to initiate an annexation process have been met and that the
proposed annexation meets a series of review criteria. The specific review criteria and
findings are included verbatim in Resolution No. 29.
Following these first two steps required by C.R.S. requirements (Resolutions 14 and 29),
the third and fourth steps will follow the City of Aspen’s typical ordinance review and
approval process. With a recommendation from the Planning and Zoning Commission,
Council will consider two ordinances at First and Second Reading (as typical, Second
Reading will be a public hearing). The first ordinance will review the proposed annexation
through the City of Aspen’s review criteria established in its adopted Annexation Plan.
The second ordinance will establish initial zoning (SCI) and create a Planned
Development overlay to memorialize and limit development on site to the existing
conditions and uses. First and Second Readings of these ordinances are scheduled for
March 22 and April 12.
DISCUSSION: In general, this Resolution (No. 29) and the previous Resolution (No. 14)
are cursory steps to initiate and review a proposed annexation under Colorado Revised
Statutes. Because of the relatively small size of the parcel being annexed, several of the
state requirements do not apply. It is staff’s view that the process and criteria under state
law have clearly been met. Staff recommends approval.
It is important to note that this Resolution does not approve the annexation or the eventual
zoning, nor will it authorize the changing of existing conditions or uses on the property in
any way.

RECOMMENDATIONS: Staff recommends that Council approve Resolution No. 029,
Series of 2022, confirming that the annexation petition process and review criteria in
Colorado Revised Statutes have been met for the Aspen Mini-Storage Property.
