REQUEST: Stream Margin Review Exemption
DESCRIPTION: The City of Aspen Parks Department plans to replace the existing playground
equipment at Herron Park. The park is immediately adjacent to the Roaring Fork River and is subject to
Stream Margin Review standards in the Land Use Code.
Pursuant to Land Use Code Section 26.435.040.B: Exemptions, the Community Development Director
may exempt this project if the following criteria are met:
1. The development does not add more than ten percent (10%) to the floor area of the existing
structure or increase the amount of building area exempt from floor area calculations by more
than twenty-five percent (25%). All stream margin exemptions are cumulative. Once a
development reaches these totals, a stream margin review by the Planning and Zoning
Commission is required;
2. The development does not require the removal of any tree for which a permit would be
required;
3. The development is located such that no portion of the expansion, remodeling or
reconstruction will be any closer to the high-water line than is the existing development;
4. The development does not fall outside of an approved building envelope if one has been
designated through a prior review; and
5. The expansion, remodeling or reconstruction will cause no increase to the amount of ground
coverage of structures within the 100-year flood plan.
A land use application must be submitted so that compliance can be confirmed.

Pre-application Conference Summary (this document).
Street address and legal description of the parcel on which development is proposed to occur,
consisting of a current (no older than 6 months) certificate from a title insurance company, an
ownership and encumbrance report, or attorney licensed to practice in the State of Colorado,
listing the names of all owners of the property, and all mortgages, judgments, liens, easements,
contracts and agreements affecting the parcel, and demonstrating the owner’s right to apply
for the Development Application. The purpose of this requirement is to show that the Applicant
has the authority to apply for a Land Use Case.

states the name, address and telephone number of the representative authorized to act on
behalf of the applicant.
A site improvement survey (no older than a year from submittal) including topography,
existing structures, and vegetation showing the current status of the parcel certified by a
registered land surveyor by licensed in the State of Colorado. This survey also is required to
depict the 100-year flood plain, the high-water mark of the roaring fork river, top of slope, and
any ditch easement that cross the property.
A written description of the proposal and response to how the proposed development
complies with the review standards relevant to the development application Section

Margin Exemption.
The scope of work for Herron Park includes:
Temporary construction and tree protection fencing
Removal of existing playground, fall zone timber edge and engineered wood fiber
Repair of existing split rail fence
Removal of existing swings, fall zone timber edge and engineered wood fiber
Removal of marble table
Removal of two picnic tables
Relocation of one bench
Installation of new playground, fall zone stone edge and engineered wood fiber
Installation of cut boulder bench
Installation of flagstone
Installation of paving stone
Installation of new wood bench
Installation of new picnic tables
Installation of crusher fine path
Installation of nature path

Lawn repair
The City of Aspen Parks and Engineering Departments have provided evidence for the
Community Development Director to make the necessary findings that the work is exempt from
further review. Among the information provided is a “No-Rise Certification” that has been
granted for the project by FEMA. Staff finds that the proposed scope of work meets the criteria
to qualify for a Stream Margin Review Exemption, per section 26.435.040.B, Exemptions.
Replacing the existing playground equipment, as well as repairing, relocating, or removing
fences, benches, and tables do not add floor area to the property. The playground footprint has
shifted and enlarged to address current safety requirements, but it is no closer to the Roaring
Fork River and there is no building envelope established for the Park restricting development
zones. The project does not require the removal of any tree or increase the amount of ground
coverage of structures within the 100-year flood plain from what currently exists.

1.Irrigate existing trees to remain via water truck or other means throughout the extent of construction until
new irrigation is operational. Irrigate min. every two weeks when natural rainfall is not abundant.
2.Install tree protection fencing as indicated on plans to protect trees to remain. Fencing to be erected at
dripline of trees at beginning of construction, and remain in place through duration of construction.
TREE PROTECTION NOTES
The Owner shall be responsible for the control of noxious weeds during the entire time period of the project and
for one year after completion. The City of Aspen shall perform monthly inspections of the area.
1.All mulching materials and seed mixes shall be certified weed free.
2.All disturbed areas during and after construction shall be maintained free of weeds. This will require a
program with a vegetation management company (or a well planed routine service program completed in
house by the City of Aspen Parks and Open Space) to perform weed management on the disturbed areas
for a period of one (1) year following project completion.
Seeding Procedure (Non-dormant Seeding):
Seeding accomplished as a portion of this project is anticipated to be a dormant seeding. Time period for
seeding operations shall be from April 15th until September 14th or other dates as approved by Parks and Open
Space Staff.

Seeding accomplished as a portion of this project is anticipated to be a dormant seeding. Time period for
seeding operations shall be from September 15th until October 15th or other dates as approved by Parks and
Open Space Staff.
1.Hand broadcast seed in areas of disturbance. Hand seeding shall be accomplished in two phases. Phase
one is complete distribution of seed in one direction, phase two requires seeding at a right angle of the first
phase. Coverage should match the seed distribution guidelines per seed mix list.
2.Hand rake seed into soil ensuring seed to soil contact
3.Hand broadcast slow release fertilizer (Bio-sol) 7-2-3
4.Cover area with certified weed free straw
5.Tackify areas of disturbance with approved Hydro-mulch (stabilize straw)
1.Plants shall be of the species or variety designated in the plans, in healthy condition with normal well
developed branch and root systems, and shall conform to the requirements of the current "American
Standard for Nursery Stock."
2.All plants shall be free from plant diseases and insect pests. All shipments of plants shall comply with all
nursery inspection and plant quarantine regulations of the State of origin and destination, and the Federal
regulations governing Interstate movement of nursery stock.
3.The minimum acceptable sizes of all plants, with branches in normal position, shall conform to the
measurements specified nursery standards.
4.All container grown plants shall be those plants that have been growing in a nursery for at least one growing
season, or plants that have established themselves in accordance with definitions set forth in the Colorado
Nursery Act, title 35, Article 26, CRS.
5.Trees and shrubs shall have been root-pruned during their growing period in the nursery in accordance with
standard nursery practice.
6.Deciduous plants, broadleaf evergreens, and conifers shall be balled and burlapped, or in containers used
in standard nursery practice. Balling and burlapping shall conform to the recommended specifications in
the "American Standard for Nursery Stock." The ball of the plant should be natural, not made, and the plant
shall be handled by the ball at all times. No balled and burlapped plant should be accepted if the ball is
broken or the trunk is loose in the ball.
7.Plants for fall planting shall be furnished balled and burlapped or container-grown unless otherwise
designated in the Contract or approved.
8.Fertilizer for planting shall be used as specified within the "Seeding Procedure" section of these
specifications.
9.All plants shall be protected from drying out or other injury. Broken and damaged roots shall be pruned
before planting.
10.Areas to be planted shall be brought to the lines and grades designated or approved. The location of plants
shown in the plans is approximate to the degree that unsuitable planting locations shall be avoided. Plant
material shall be placed according to the approved planting plans, or as directed in the field by the
Landscape Architect.
11.Planting pits shall be circular in outline with vertical or sloped sides. Pits for trees and shrubs shall be at
least two times greater in diameter than the earth ball.
12.Planting shall be done in accordance with good horticultural practices. Plants of upright growth shall be
plumb and plants of prostrate type shall be set normal to the ground surface. Plants with dry, broken, or
crumbling roots will not be accepted for planting.
13.Planting pits shall be dug 1 inch shallower than the height of the rootball for shrubs. The tree rootball shall
be set in the center of the planting pit on undisturbed soil. Trees shall be stabilized and then the wire basket,
any twine or wire, and burlap shall be removed before the pit is backfilled. Shrubs shall be planted in the
center of the pit. Plastic, metal, fabric, or peat containers shall be removed. Shallow scores 1
4 to 1
2 inch deep
shall be made along the edges of the rootball.
SEEDING NOTES
1.Typical salvageable on site topsoils should be stock piled and utilized as determined viable by soil testing.
Topsoils on site should be amended as recommended based on soil testing results. Contact Colorado
State University to send soil samples and work with them for achieving quality top soil for optional plant
health. Maintain topsoil piles to be free of weeds and weed seed.
2.When soil conditioner is specified, composted plant material shall be added and thoroughly mixed into the
backfill material at the rate of 0.5 cubic foot per tree and 0.1 cubic foot per shrub.
3.Backfill shall be thoroughly worked and watered-in to eliminate air pockets. Watering shall be done
immediately after the plant is placed. Backfilling of the planting pit shall be resumed after this water is
absorbed. Roots and ball shall be covered with soil at this time. After the soil has settled, plants must be
in the proper position and at the proper depth. Saucers shall be prepared around each plant to the
dimensions shown on the planting details. When saucers are required they shall be covered with a 2-3
inch thick layer of fresh moist wood chip mulch. After completion of all planting and before acceptance of
the work, the Contractor shall water plants installed under this contract, as needed to maintain a moist root
zone optimum for plant growth. Plants damaged by the Contractors's operations shall be replaced at the
Contractors expense.
4.Surplus soil remaining after backfilling is completed shall be used for constructing water retention berms,
or, if not needed for berms, shall be thinly distributed (wasted) in the vicinity.
Pruning:
All deciduous trees and shrubs shall be pruned in accordance with ISA standards, preserving the natural
character of the plant, but ensuring safe branching structure in all trees near people and structures.
Pruning cuts shall be made with sharp clean tools. All clippings shall be removed from the site.
Landscape Establishment:
From the time of installation, during construction, and throughout the Landscape Establishment period, all
plant material and seeded areas shall be maintained in a healthy and vigorous growing condition, to
ensure the successful establishment of vegetation. This includes performing establishment, replacement
work, and landscape maintenance work as described below.
Establishment and Replacement:
Dead, dying, or rejected material shall be replaced each month during the Landscape establishment
period as directed. Plant replacement stock shall be subject to all requirements specified for the original
material.
Woody Plant Material Establishment & Maintenance:
The Owner shall perform landscape maintenance as described herein. The Owner shall maintain all
landscaped areas in the condition they were first installed and accepted.
Seeded Area Establishment and Maintenance:
The Owner shall restore and reseed disturbed and eroded areas. The Owner shall maintain all seeded
areas in the condition they were in when first installed and accepted. Seeded areas will be accepted when
germination has reached 85% coverage. Areas of poor establishment shall be re-seeded by the Owner.
