DESCRIPTION OF PROPOSAL AND COMPLIANCE WITH STANDARDS
APPLICATION FOR AMENDMENT TO CONDOMINIUM MAP
Unit 202, Mill Building Condominium
201 N. Mill Street, Unit 202, Aspen CO 81611
1. Introduction. The Applicant own one condominium unit at the Mill Building,
which is Unit 202 comprised of approximately 3,421.5 s.f. ("Unit 202"). The Applicant seeks to
amend and restate the existing Condominium Map as to Unit 202. The Mill Building
Condominium was created by that certain Condominium Map thereof recorded May 12, 2016 in
Plat Book 114 at Page 60 as Reception No. 629290 ("Condominium Map"), and as defined and
described in the Condominium Declaration for the Mill Building Condominium recorded May
10, 2018 as Reception No. 629258 ("Declaration") of the records of County of Pitkin, Colorado.
The Condominium Map is submitted with this Application. Unit 202 is located on the Second
Floor as reflected in the existing Condominium Map:

2. Pre -Application Conference. The Applicant held a pre -application conference
and a pre -application conference summary was issued on March 30, 2021, a copy of which is
submitted with this Application.
3. Summary of Application. At the time of recording the existing Condominium
Map Unit 202 was unfinished. Subsequently, a portion of Unit 202 consisting of approximately
2,698.3 s.f. was built out and tenant improvements were made, and that portion of Unit 202 is
currently occupied by a tenant. During the build out of this portion of Unit 202, a demising wall
was constructed creating the 2,698.3 s.f. portion of Unit 202, and leaving an approximate 723.2
s.f. portion of Unit 202, that was then leased to the City of Aspen, which completed tenant
improvements in the remaining 723.2 s.f. portion. A floor plan of existing Unit 202 is below:

The Applicant seeks to obtain a subdivision exemption to amend the Condominium Map
to create a new Unit 203 comprising the 723.2 s.f. portion of existing Unit 202, and reducing the
size of Unit 202 as shown in the existing Condominium Map by 723.2 s.f. The Applicant has
three parking spaces in the Mill Building garage allocated as limited common elements. The
Applicant intends to assign one parking space as a limited common element to new Unit 203 and
keep the other two parking spaces assigned as limited common elements of the reduced size Unit
202. No City approvals are required to reassign the parking spaces.
There is no increase in the gross square footage of existing Unit 202, although there is a
minor reduction in the net leaseable square footage of both proposed Units due to the square
footage of the demising wall between the two proposed Units.
There are no changes to any of the other Units or improvements in the Mill Building.
Each of the two proposed Units have separate ingress and egress. The reduced size Unit 202 will
continue to have ingress/egress to and from south -facing portion of the Commercial Entry G.C.E.
at the southeast corner of the Second Floor and ingress/egress to and from the Stair 1 G.C.E. at
the northwest corner of Unit 202. Proposed Unit 203 will continue to have ingress/egress to and
from the east -facing portion of the Commercial Entry G.C.E. at the southeast corner of the
Second Floor and ingress/egress to and from the Entry G.C.E. to the west of proposed Unit 203.
Because amendments to condominium maps are subject to subdivision requirements set
forth in Chapter 26.480 of the Aspen Land Use Code, the Applicant seeks approval to amend and
record an amendment to the existing Condominium Map in the form submitted herewith.
4. Review Standards.
A. The Application is subject to Aspen Land Use Code Section 26.480.20.
Standard: This Chapter shall apply to creating, amending, aggregating, or vacating
separate deeded interests in a property including fractional fee interest, timeshare or time -
span estate, condominium interest, interest in a common interest community, or similar
forms of real estate interest.
Response: The Application proposes to amend the Condominium Map to reflect the
demising wall between Unit 202 and proposed Unit 203, so that the interior dimensions of the
units set forth on the Condominium Map reflect the actual existing demising wall and interior
dimensions.
B. The Application is subject to review by the Community Development Director as
an "Administrative Subdivision" in accordance with Sec. 26.480.030 — "Procedures for review".
Standard: The Community Development Director shall approve, approve with
conditions or deny the application, based on the standards of review in Section 26.480.050,
Administrative Subdivisions.

Response: The Application to amend the dimensions of the Units on the Condominium
Map is an "Administrative Subdivision " pursuant to Section 26.480.050 as described below and
accordingly is subject to approval by the Community Development Director.
C. The Application's proposed amendment is an administrative subdivision subject
to the review by the Community Development Director pursuant to the standards of Aspen Land
Use Code Section 26.480.050(a), Condominiumization.
Standard: 26.480.050 Administrative Subdivisions. The following types of
subdivision shall be approved, approved with conditions, or denied by the Community
Development Director, pursuant to Section 26.480.030 - Procedures for Review, and the
standards and limitations of each type of subdivision, described below: (a)
Condominiumization. A subdivision to establish, amendzor vacate separate ownership
interests of a single property in a Condominium ... shall be approved, approved with
conditions, or denied by the Community Development Director.
Response: The Application proposes to amend the dimensions of existing Unit 202 to
reflect the demising wall between Unit 202 and proposed Unit 203, so that the interior
dimensions of the units set forth on the Condominium Map reflect the actual existing demising
wall and interior dimensions. As such the Application qualifies for an administrative subdivision
exemption to establish separate ownership interests of a single Unit in a Condominium.
D. The Application's proposed Amended Condominium Map complies with the
standards for Condominium Plats set forth in Aspen Land Use Code Section 26.480.050(a),
Condominiumization.
Standard: The Condominium Plat is in an acceptable style and format as prescribed
in Title 29 — Engineering Design Standards for Condominium Plats.
Response. The First Amendment to the Condominium Map of the Mill Building
Condominium is hereby submitted for review and approval by the Community Development
Department and the Engineering Department.
E. The Amended Condominium Map is a Condominium Plat and is subject to the
recording requirements of Section 26.480.050(a).
Standard: The Condominium Plat shall be reviewed and then recorded in the office
of the Pitkin County Clerk and Recorder. No subdivision agreement need be prepared or
entered into between the applicant and the City unless the Community Development
Director determines such an agreement is necessary.
Response: The First Amendment to the Condominium Map of the Mill Building
Condominium will be recorded in the office of the Pitkin County Clerk and Recorder. No
subdivision agreement should be required as there are no public infrastructure requirements
applicable to this Application.
