B. As such, the Percentage Assessment Obligation of each Unit that has not been further subdivided into Fractional Ownership interests is 1.89%, and the Percentage Assessment Obligation of each Unit within a Fractional Project is 0% (as no Units currently subject to this Declaration have been subdivided into Fractional Ownership Interests). The Percentage Assessment Obligation of each Unit shall be adjusted upon the inclusion of additional Units in the Association. The Percentage Assessment Obligation of each Unit within an Fractional Project will be allocated to the Owners of the Fractional Ownership Interests comprising such Unit on the same basis as such Owners' fractional interest in the Unit; meaning, by way of example and not of limitation, that if a Unit is divided into Fractional Ownership Interests constituting a 1/8 share of such Unit, then each Fractional Ownership Interest therein shall be allocated 1/8 of the Percentage Assessment Obligation with respect to such Unit. 07444085.DOCX;44 RECEPTION#: 686671, R: $178.00, D: $0.00 DOC CODE: APPROVAL Pg 1 of 34, 03/04/2022 at 09:58:06 AM Janice K. Vos Caudill, Pitkin County, CO SiteSafe A C MWnY I Executive Summary 1.1 General Upon evaluation of the cumulative RF exposure levels from all operators at this site, T-Mobile has contracted with Site Safe, LLC (Sitesafe), an independent Radio Frequency (RF) regulatory and engineering consulting firm, to determine whether the communications site, DN01587A - Aspen Highlands, located at 197 Prospector Rd, Aspen, CO, is in compliance with Federal Communications Commission (FCC) rules and regulations for RF exposure. This report contains a detailed summary of the RF environment at the site including: • Site compliance determination • Diagram of the site • Inventory of the make / model of all antennas • Record of any Maximum Permissible Exposure ("MPE") measurements taken on the site, as applicable • Theoretical MPE based on predictive modeling 1.2 Site Classification & FCC MPE Limits This report addresses exposure to radio frequency electromagnetic fields in accordance with FCC rules and regulations for all individuals, classified in two groups —Occupational (Controlled) and General Public (Uncontrolled). The FCC defines two sets of MPE limits for these groups. Occupational limits apply in situations in which persons are exposed as a consequence of their employment and where those persons have undergone proper RF awareness training, have been made fully aware of the potential for exposure, and can exercise control over their exposure. General Public limits, conversely, apply to accessible areas where workers or the general public may be exposed and have not undergone RF awareness training, may not be aware of the potential for exposure, and may not be able to exercise control over their exposure. For the frequency bands the commercial wireless carriers operate in, the General Public MPE limits are five times more conservative than the Occupational MPE limits. That is, there is a much stricter standard of compliance in areas that are accessible by the general public. 1.3 Site Compliance Statement Upon evaluation of the cumulative RF exposure levels from all operators at this site, Sitesafe has determined that: T-Mobile's proposed modifications are compliant with FCC rules and regulations, as described in OET Bulletin 65. Note: If any work needs to be done on the rooftop, T-Mobile should work with the landlord to ensure the T-Mobile antennas are powered down before any work commences. This document and the conclusions herein are based on the information provided by T-Mobile. If you have any questions regarding RF safety and regulatory compliance, please do not hesitate to contact Sitesafe's Customer Support Department at (703) 276-1100. 8618 Westwood Center Drive • Suite 315 • Vienna, VA 22182 703.276.1100 • info@sitesafe.com Page 3 RECEPTION#: 685671, 03/04/2022 at 09:58:06 AM, Pgs 24 of 34, Janice K. Vos Caudill, Pitkin County, CO (w)SiteSafe A 2 Technical Framework 2.1 FCC Rules and Regulations In 1996, the FCC adopted regulations for evaluating the effects of RF emissions in 47 CFR § 1.1307(b) and 1.1310. The guideline from the FCC Office of Engineering and Technology is Bulletin 65 (OET Bulletin 65), Evaluating Compliance with FCC Guidelines for Human Exposure to Radio Frequency Electromagnetic Fields, Edition 97-01, published August 1997. Since 1996, the FCC periodically reviews these rules and regulations as per its congressional mandate. FCC regulations designate two separate tiers of exposure limits: Occupational (Controlled) and General Public (Uncontrolled). Areas are considered controlled when the environment is restricted or "controlled" in order to prevent access from members of the general public or untrained workers. Conversely, areas are considered uncontrolled when access is unrestricted or "uncontrolled" which allows access from members of the general public or untrained workers. A controlled environment can be evaluated with Occupational MPE limits whereas uncontrolled environments should always be evaluated with General Public MPE limits. The MPE limits utilized in this analysis are outlined in the following diagram and table: FCC Limits for Maximum Permissible Exposure (MPE) Plane -wave Equivalent Power Density 1000 0.01 —Occupational — -General Public \ i 0 1 10 100 1,000 10,000 Frequency (MHz) 8618 Westwood Center Drive • Suite 315 • Vienna, VA 22182 703.276.1100 • info@sitesafe.com Page 4 RECEPTION#: 685671, 03/04/2022 at 09:58:06 AM, Pgs 25 of 34, Janice K. Vos Caudill, Pitkin County, CO SiteSafe A C 3 General Safety Recommendations The following are general recommendations appropriate for any site with accessible areas in excess of 100% General Public MPE. These recommendations are not specific to this site. These are safety recommendations appropriate for typical site management, building management, and other tenant operations. 1) All individuals needing access to the main site or the area indicated to be in excess of General Public MPE should wear a Personal Protective Monitor (PPM), successfully complete proper RF Safety Awareness training, and have and be trained in the use of appropriate personal protective equipment. Awareness training increases a worker's understanding of potential RF exposure scenarios. Awareness can be achieved in a number of ways (e.g. videos, formal classroom lecture or internet-based courses). Sitesafe strongly recommends the use of a PPM. Wearing a PPM will properly forewarn the individual prior to entering an RF exposure area that may approach or exceed the exposure limits. 2) Any maintenance personnel required to work immediately in front of antennas and/or in areas indicated as above 100% of the Occupational MPE limits should coordinate with the wireless operators to disable transmitters during their work activities. 3) Access restrictions to transmitting antenna locations is the primary element in a site safety plan. Examples of access restrictions are as follows: • Locked door or gate • Alarmed door • Locked ladder access • Restrictive barrier at antenna(s) (e.g. chainlink with posted RF signage) 4) All individuals needing access to the main site should be instructed to obey all posted signs at all times. RF signage plays an important role in properly warning a worker prior to entering into a potential RF exposure area. 5) Individuals should always assume all antennas are active. Due to the nature of telecommunications transmissions, an antenna transmits intermittently. Always assume an antenna is transmitting and never stop in front of an antenna. If someone must pass by an antenna, they should move through in a transient manner as quickly and safely as possible, thereby reducing any exposure to a minimum. 6) The site should be routinely inspected and this or a similar report updated with any changes to the RF environment including: • addition of new antennas that have been located at the site • removal of existing antennas that are no longer present at the site • addition of new frequency bands on any antenna systems • changes in the radiating power and/or number of RF emitters 8618 Westwood Center Drive . Two types of measurements were collected at each measurement location: maximum (peak) and spatial average. The spatial average measurement consists of a collection of measurements within a ten (10) second time interval taken from zero (0) to six (6) feet in height. The purpose of this measurement technique is to identify the average power density over the dimensions of a typical human body. See the diagram(s) in Section 6 for the location of each measurement. The measurement points on the diagrams (M 1, M2, etc.) correspond with the table below. For areas that may exceed the MPE limits for which RF signage/barriers are required for site compliance, the recommended mitigation is shown in the diagram(s) in Section 6. T-Mobile's proposed modifications are compliant with FCC rules and regulations, as described in OET Bulletin 65. To reduce the risk of exposure and/or injury, Sitesafe recommends that access to the rooftop or areas associated with the T-Mobile antenna installation be restricted to authorized personnel who have undergone proper RF awareness safety training. Additionally, all signs and barriers should be obeyed at all times and any work that must be performed in close proximity to the T-Mobile antennas should be coordinated in advance with T-Mobile to ensure safe working conditions. Workers can call the T-Mobile NOC Number at 1-888-662-4662 for guidance. 8618 Westwood Center Drive • Suite 315 • Vienna, VA 22182 703.276.1100. info@sitesafe.com Page 13 RECEPTION#: 685671, 03/04/2022 at 09:58:06 AM, Pgs 34 of 34, Janice K.
