Galena St. 1 (970) 920 5090 APPLICATION FOR ADMINISTRATIVE SUBDIVISION FOR BOUNDARY ADJUSTMENT AND PLAT AMENDMENT VillaSanta (Lot 1, Starodoj Subdivision) and Hayes (Lots 4 and 5, Block 19, Riverside Addition) Summary of the Application In this Application, the Applicants seek approval for a boundary adjustment to accommodate retaining wall and landscaping encroachments from the Hayes' property onto the VillaSanta property. The encroachments have existed since the late 1980's or early 1990's. The Applicants propose to exchange equal square footage parcels of land so that the Hayes' encroachments will be located entirely on the Hayes' property. The Applicants do not propose any changes of the uses of the properties, all of which are single family residential. All of the improvements on both properties conform to zone district regulations. A draft Boundary Line Adjustment Plat is appended hereto as Attachment 1. An existing conditions Boundary and Topographic Survey is appended as Attachment 2. LAND USE CODE STANDARDS Sec. 26.480.050. ADMINISTRATIVE SUBDIVISION C. An adjustment of a lot line between contiguous lots shall be approved, approved with conditions, or denied by the Community Development Director, pursuant to Section 26.480.030, Procedures for Review, according to the following standards: 1. The request permits a boundary adjustment between contiguous parcels or corrects an error in a recorded plat. RESPONSE: The boundary adjustment is between contiguous parcels for the specific purpose of addressing encroachments. 2. The adjustment results in the same number of parcels. Changes in development rights for the individual lots may occur unless specifically prohibited by the original subdivision documents. RESPONSE: There will be no change in the number of parcels. The square footage of each lot will remain the same. There are no original subdivision documents that prohibit or otherwise impact the proposed boundary adjustment. 3. The request complies with the requirements of Section 26.480.040, General Subdivision Review Standards. RESPONSE: Section 26.480.040 requires compliance with the following: A. Guaranteed access to a public way —both parcels are served by public streets; B. Alignment with original townsite plat —the VillaSanta property is not part of an original townsite plat or addition. The Hayes property is part of the Riverside Addition. The Hayes property boundaries will remain substantially in conformance with the Riverside Addition; C. Zoning conformance —both properties will continue to fully comply with all of the zone district regulations for the moderate -density residential (R-15b) zone district; and D. Existing structures, uses, and non- conformance — all structures on both properties are conforming and no non -conforming structures will result. 4.
