Parcel ID No. 2735-12-47-8009 APPLICANT: Sunni McBride 320 N 7th Street Aspen, CO 81611 REPRESENTATIVE: Cody Gabaldon, 1/1 Workshop Box 4862 Basalt, CO 81621 SUBJECT & SITE OF APPROVAL: The Applicant has requested alternative compliance for the Residential Design Standard requiring a projecting one-story element (26.410.030.B.4). The subject property is at 320 North 7th Street, with a Parcel ID of 2735-12-47-8009, and legally described as listed above. SUMMARY: The applicant is proposing a remodel of the existing condominium, which will relocate the front door from the south side of the building to the west. This change will orient the building to North 7th Street rather than the alleyway. The applicant will still take access from the alley, as the remodel proposes the addition of a single car garage accessed via the alley, with an art studio above the garage. The Residential Design Standards (Chapter 26.410) apply to this application. The applicant has provided responses to the Administrative Compliance Review Applicant Checklist. The proposal complies with all standards except 26.410.030.B.4 Projecting One-Story Element. Pursuant to One Story Element (Flexible) 26.410.030.B.4.D.1 Projecting One-Story Element, the front façade of the principal building shall have a one-story street-facing element that projects at least six (6) feet from the front façade and has a width equivalent to at least twenty percent (20%) of the building's overall width. The application proposes a porch and porch roof as the one-story street-facing element. The Page 2 of 3 width exceeds the requirement of at least 20 percent of the building’s overall width; however, the proposed porch does not project up to six feet as indicated in the standard. The applicant is seeking a Residential Design Standard Variation. STAFF EVALUATION: The applicant is proposing to remodel an existing structure, which presents site constraints as the building is located close to the side lot line along N 7th Street, which as part of the remodel will become the front façade of the unit. Because of the location of the existing structure, there is only about 2.8 feet between the building and the side setback line along N 7th Street, where the one-story street-facing element is required. Therefore, due to site-specific constraints, the applicant is not able to meet the protrusion requirement as laid out in the 26.410.030.B.4.D.1 Projecting One-Story Element Residential Design Standards without encroaching on the side yard setback. The applicant is therefore proposing a porch roof that extends 18 inches into the setback as allowed in 26.575.020.E.5.G Allowed Projections into Setbacks: “Setback areas shall be unobstructed above and below ground except for the following allowed projections: g. Building eaves, bay windows, window sills, and similar architectural projections up to eighteen (18) inches as measured from the setback boundary.” This protrusion will allow the applicant to gain the largest possible roof for this porch given the existing building’s proximity to the setback, measuring four feet four inches in total. To conform with the setback requirement, the porch would not connect to the ground. While the porch still does not meet the protrusion requirement set forth in the Residential Design Standards, the applicant is making a reasonable effort to bring that element into compliance. The main level site plan proposal shows a proposed on-grade front porch with roof that is greater than 20 percent of the building’s overall width, demonstrating compliance with this portion of the section. The applicant has demonstrated that the proposal fits the intent of the code, in that the first and second stories are demarcated by architectural elements. The front porch roof of the first floor encompasses the main level porch, and the upper deck is behind the front porch roof. DECISION: The Community Development Director finds the requested Variation to the Residential Design Standards for the street-facing one-story element as noted above meets the requirements as described in the Land Use Code, and hereby APPROVES the request.
