Determination: This gth day of July 2021, the following alteration has been approved as represented in the land use application. Project Details and Review Criteria The applicant is undertaking site improvements to a commercial space that includes the extension of the existing deck as represented in the land use application. This approval does not approve the food cart and associated features. The following is a condition of this approval: • Any furniture in this space must be temporary and easily removable. Permanent seating and/or associated features will not be permitted with this approval. The project qualifies for a Certificate of No Negative Effect according to Section 26.415.070.E of the Municipal Code as it entails site improvements to a landmark property in the historic district. The property is located in the background of the Courthouse View planes but the proposed changes do not create an infringement into the view plane nor visible increases in height or mass of the building from the reference points (Section 26.435.050). Based on a review of the applicable Commercial, Lodging and Historic Design Standards and Guidelines, staff finds the proposed workwill not diminish, eliminate or adversely affectthe historic landmark or significant historic and/or architectural character of the Historic District in which it is located.
