Slide 4:
• The second component of the request by the St. Regis is to install and maintain fencing
which was built without a permit that exceeds height limitations as required per underlying
zoning along Monarch Street and “June -ee-aat-ah” Street to deter animal and human
trespass.
• Per the land use code, fences located between buildings and streets shall not be taller than
42 inches in height.
• Fences may be 6 feet in height when located on a non-street-facing side or rear yard
setback that is fully recessed behind the vertical plane of the building ’s facade which is
closest to the Street.
• The current locations of the request would only allow the fence to be built 42 inches in
height per underlying zoning as the fence is street facing.
• The Applicant seeks a variation from this standard to erect and maintain fencing ranging in
height from 6 feet to 10 feet.
• The image on the right is a summary of the requests of fence and gate heights along the
two streets
• The image on the left shows the fencing that was erected without a permit compared with
the existing gate and retaining wall height.
