Slide 7:
• The second component of the request by the St. Regis is to install and maintain fencing
which was partially built without a permit that exceeds height limitations as required per
underlying zoning along Monarch Street and at the corner of Monarch Street and “June -ee-
aat-ah” Street to deter animal and human trespass.
• The City has set many standards within the LUC to ensure fences support neighborhood
character and maintain a connection between pedestrians and neighborhoods.
• Per the land use code, fences located between buildings and streets that are not fully
recessed behind the vertical plane established by the building’s façade closet to the street
shall not be taller than 42 inches in height.
• The Applicant seeks a variation from this standard to erect and maintain fencing ranging in
height from 6 feet to 10 feet.
• The image on the right is a summary of the requests of fence and gate heights along the
two streets.

• I’d like to make note of a permit that was issued for a 6’ fence on Juniata Street which is
circled in the red bubble – the blue bubble and line along Monarch Street and at the corner
did not receive a permit, some of what we will be looking at this evening is fencing that was
erected without a permit at those locations.

• The next few slides are representations of the applicant’s request, what is existing, and
some before and after images of the fencing, starting at the bottom of Monarch Street
closest to Dean Street (right across from Dolinsek Gardens Park) moving up towards
Juniata Street

• The request of this section is to keep the fencing installed without a permit that ranges
from 6 feet 9 inches to 10 feet in height. This is behind mechanical equipment that is
placed along the sidewalk

• This next section includes the two gate entries and the planters along Monarch

• This image shows a before and after of what was previously installed and what was
installed this past year – You can see the gate is 42” so the previous fencing met the
underlying zoning whereas the new fencing is 6 feet 7 inches with the proposed gate
height of being 6 feet

• The request is to install fencing on top of the existing retaining walls and planters. This
would increase the height to range from 8 feet 11 inches to 5 feet 4 inches

• IN addition to the fencing on top of the planters the applicant requests a 6 foot fence
and to maintain the illegally built fencing to the right of the gate which currently
measures 6 feet 5 inches
Slide 16:
• The final portion of fencing is along the corner of Juniata and Monarch
Slide 17:
• This is a before and after of the fencing which at its highest point reaches 6 feet 8 inches.
• In looking comprehensively at the fencing request, staff acknowledges it may be difficult
to keep human and wildlife trespassers out of the courtyard due to the location, design
and desire to use the amenities, but Council should also consider ramifications in
increasing the height set by underlying zoning allows for fencing along a pedestrian
corridor
• Tall fences create visual obstructions, which can negatively impact the pedestrian
experience, undermine neighborhood character, and diminish a sense of place.
• Staff feels that other safety features should be considered in lieu of increasing the
fencing to 10 feet
o Such examples as installing coverings over light wells; amping up safety onsite;
closing the gap between the ground and the fence as seen in this before and
after image can help the St. Regis secure the site while still complying with land
use code.
Staff believe the Building Code could apply which allows for a fence to be up to 48” in height
as it surrounded a pool/spa.
Ultimately, Council is the final decision maker on amending the PD and to allow fence height
greater than underlying zoning..

Fences and hedges less than forty-two (42) inches in height, as measured from finished
grade, are permitted in all required yard setbacks. Fences and hedges up to six (6) feet in
height, as measured from finished grade, are permitted only in areas entirely recessed
behind the vertical plane established by the portion of the building facade which is closest
to the Street. This restriction applies on all Street-facing facades of a parcel. (Also see
