Summary of Previous Meeting
•Original Request: Treat 25’ buffer like setback

Current Request
Am end Resolution No. 58, Series of 1994 to allow for the
types of activities and improvements allowed in setbacks
per the Land Use Code EXCEPT for:
•Hot Tubs and Pools
•Perm anent Outdoor Grills, Seating Areas, and Similar
Structures
•Heating,AC ,and similarM echanical Equipm ent
•Drivew ays
•Parking Areas
•Trash and Recycling Enclosures
‐ After previous hearing, alternatives were discussed with applicant on how to proceed.
‐ Applicant request

•Foundation footers or below grade soil stabilization
infrastructure
•Building eves
•Bay windows, window sills, and similar architectural
projections
•Lightwells and fire escapes
•Patios and walkw ays ( < 6” above or below grade)

•Other non-perm anent features

Staff Recommendation:
Staff supports any outcom e that provides clarity to the types of
improvem ents and activities allowed in the 25’ buffer.
Approving Resolution #26, Series of 2020 would:
•Improve consistency of regulations with Land Use Code,
•Increase the types of activities allowed,
•but restrict more impactful types improvem ents in setbacks.
All other areas outside the building envelope are subject to the
allowances as established by the Land Use Code.
Resolution #26, Series of 2020 has no impact on existing easem ents.
Pedestrian Access easem ent rem ains unobstructed and open for
pedestrian access.
‐ Staff seeks clarity, fairness, and consistency from this process
‐ Preference is 100% consistency with land use code
‐ Unique site specific approvals create challenges for owners and staff.
‐ however, in response to Council direction, staff is supportive of the more
restrictive list of activities and improvments
‐ Important to consider immediate neighbor support (originally for), existing conditions,
and fairness and consistency

Alternatives
Options:
1. Approve CurrentRequest and draft Resolution.
2. Take no action –Resolution No. 58, Series of 1994 rem ains in place
including current developm ent restrictions.
3. C ontinue hearing –request Applicant consider a division of
buffer and setback area, or any other alternative Council and the
Applicant is supportive of.
‐ Staff seeks clarity and seeks consistency in application of development restrictions
‐ Important to consider immediate neighbor support, existing conditions, and desire to
seek clarity and simplification
‐ Staff supports direction from Council
