Property: 549 Race Alley; Legally described as Lot 5, Fox Crossing Subdivision,
City and Townsite of Aspen Colorado. PID# 2737-073-92-005.
Determination: This 12th day of April, 2021, the following alterations have been approved
as represented in the land use application.
Project Details and Review Criteria
The applicant is undertaking site improvements that include the installation of hardscaping and a
stormwater mitigation system. The following is a detailed list of the proposed changes reflected
in the submitted plans:
• Construct a new outdoor patio on the north side of the property adjacent to the non-historic
addition that includes a permanent grill in a code compliant location
• Relocate existing mechanical AC units with a sound mitigation fence on the north side of
the property adjacent to the non-historic addition in a code compliant location
• Install a new stormwater mitigation system on the north side of the property that includes
a trench drain and drywell with no visual impacts to the historic resource
• Remodel existing patio on the south side of the property adjacent to the non-historic
addition that includes a new hot tub in a code compliant location
• Modify the fence and gate along the south side of the property
The project qualifies for a Certificate of No Negative Effect according to Section 26.415.070.B of
the Municipal Code as it entails the installation of site improvements that do not impact the exterior
physical appearance of the historic resource.
Based on a review of the applicable Historic Preservation Design Guidelines, staff finds that the
work will not diminish, eliminate or adversely affect the significant historic and/or architectural
character of the subject property on which it is located and that the design guidelines applicable
to this scope of work are met, with no conditions.
