Summary of Previous Meeting
•Original Request: Treat 25’ buffer like setback
•Concerns:
•Additional activity and allowances in buffer
•Potential impacts of additional activities (i.e. noise &
lighting).
•Inconsistent with previous Council intent and
direction.
•Alternatives Discussed:
•Keep restrictions in place.
•Split 25’ into distinct buffer and setback.
Current Request
Amend Resolution No. 58, Series of 1994 to allow for the
types of activities and improvements allowed in setbacks
per the Land Use Code EXCEPT for:
•Hot Tubs and Pools
•Permanent Outdoor Grills, Seating Areas, and Similar
Structures
•Heating,AC,and similar Mechanical Equipment
•Driveways
•Parking Areas
•Trash and Recycling Enclosures
Staff Recommendation:
Staff supports any outcome that provides clarity to the types of
improvements and activities allowed in the 25’ buffer.
Approving Resolution #26, Series of 2020 would:
•Improve consistency of regulations with Land Use Code,
•Increase the types of activities allowed,
•but restrict more impactful types improvements in setbacks.
All other areas outside the building envelope are subject to the
allowances as established by the Land Use Code.
Resolution #26, Series of 2020 has no impact on existing easements.
Pedestrian Access easement remains unobstructed and open for
pedestrian access.
