The Subject Property Requesting Approval of a Stream Margin Review for LPRP Mill LLC,
Lot 10 Black Birch Estates Subdivision - LPA-23-070 (Parcel ID # 2735-013-07-017)
Dear Amy,
LPRP Mill LLC (“Applicant”) owns a developed single-family lot located at 1100 Black Birch
Drive. An application for a Stream Margin Review was submitted for this property on August 1,
2022.
The Applicant is providing a supplemental affidavit the former property owner at 1100 Black Birch
Drive, Christine Gordon, pursuant to discussions with Luis Prado, Zoning Enforcement Officer.
The attached affidavit includes personal knowledge pertaining to the existence of major
landscaping improvements installed prior to Ordinance 95-1995 which enacted the riparian setback
requirement from the high-water mark. This Ordinance is discussed in detail in the land use
application.

DECLARATION OF CHRISTINE GORDON
LANDSCAPE IMPROVEMENTS TO 1100 BLACK BIRCH DRIVE PRIOR TO 2004
I, Christine Gordon, declare as follows:
1. I am over the age of eighteen and have personal knowledge of the facts contained in this
Declaration.
2. I was the former property owner with my husband Sheldon Gordon of 1100 Black Birch
Drive, Aspen, Colorado, 81611 ("Property"). During our ownership starting in late 1991, we inherited,
installed, and performed landscaping at the Property.
3. We had a lawn down to the river and paths with stepping stones early on, and I recall
birthday parties on the lawn by the river with my daughter, a toddler, in the early 1990s.
4. Some of the major landscaping improvements that we had designed and installed at the
property during the period of our ownership included a flagstone walkway from the house down to the
Roaring Fork River and off to the right to an area where we had a dining table, chairs and a couple of
lounge chairs and ottomans by the river which we loved. Not far away, we also had children's play
equipment installed: swings, slides, etc., so we could easily watch the children play from this lovely
outdoor area. We had a dense Bluegrass lawn from the house down to the rocky edge of the Roaring
Fork River. In addition, we had to install a rather large culvert further up from the river to protect
against flooding, as the property is very close to the confluence of the Roaring Fork River and Maroon
Creek. Hence, my late husband and I named the property "River Run."
5. Some of this landscaping work was done shortly after we became owners, and we
continued to make the yard and gardens by the river nice and useable.
6. I recall that we improved the yard over the years. The DNC asked us to host a cocktail
and dinner party for 100 guests in honor of then -President Bill Clinton. Before that summer event, we
had planned a MAJOR landscaping plan. Thus, we gathered the gardeners working on the installation
and told them that we had been asked to host the event for the President, gave them the date, and told
them we could not do the event unless the landscape on the river side of the house was completed the
week prior to the event. We also told them they would each be invited to the outdoor Cocktail Event
before the dinner for 100 people inside our home. They assured us that they would commit to
completing the work on time. They did, and it was sensational! When the President entered our house, I
told him what the gardeners had done and that they were all out in the garden and would love the
opportunity to meet him. The President spent so much time with the gardeners talking and picture -
taking that the DNC was furious as it threw off their schedule for the President to enter the house for
Dinner!
7. I declare under penalty of perjury under the laws of Colorado that the foregoing is true
and correct.
