LPRP Mill LLC Withdrawal of Land Use Application
Dear Kate:
We appreciate the opportunity to conduct a site visit of 1100 Black Birch Dr. (the “Property”) to
discuss the List of Violations the City sent on April 17, 2024. As was stated during the site visit, LPRP Mill
LLC (the “Applicant”) is working with a surveyor to verify the location of the pickleball court and is also
in the process of verifying floor area calculations, among other things. The Applicant is also evaluating
what, if any, additional diligence may be needed to resolve this enforcement matter.
As you are aware, there is a pending land use application for the Property that was submitted by
Davis Horn Planning on behalf of the Applicant on August 1, 2023 in response to the City’s Notices of
Violation issued on November 19, 2020 and March 23, 2023. It is the Applicant’s position that this pending
land use application may not accurately reflect the existing site conditions, and the Applicant desires
additional time to fully evaluate all of its options once it has completed additional diligence. Therefore,
the Applicant hereby withdraws the pending land use application. It is the Applicant’s intent to continue
to work amicably with the City toward a resolution of this matter. Please let me know if you have any
