SUBJECT: Engineering Department Referral Comments
PROJECT: LPA-23-086, 1100 Black Birch Drive
COMMENTS:
These comments are not intended to be exhaustive, but an initial response to the Land Use application
submitted for review. Other requirements may be requested at time of permit.
1. A Letter of Map Amendment (LOMA) must be applied for in order to use the proposed 100-year
flood plain delineation. FEMA is the authority for determining the 100-year flood plain
delineation.
a. Any structures or other items determined to impact the flood way that were not legally
established that remain in the flood plain after FEMA’s decision or if a LOMA is not
pursued, must be removed.
2. No part of the building envelope can be within the 100-year flood plain delineation. The 100-
year flood plain delineation is subject to the LOMA application decision or will be subject to the
existing mapped 100-year flood plain.
3. All appropriate FEMA Elevation Certificates must be obtained.
4. Any structures not legally established that are to remain and become legally established
structures must mitigate for Water Quality Capture Volume (WQCV).
5. All structures not legally established within the located riparian zones must be removed.
