REQUEST: Stream Margin Review Exemption
DESCRIPTION: The entirety of the subject property is located within the Stream Margin Review Area adjacent to
the Roaring Fork River. The parcel contains an existing, single family residence that was built prior to Stream Margin
review standards. In 1990, a deck adjacent to the Roaring Fork River received Stream Margin Approval. The property
contains a ditch and related ditch easement, and numerous trees. The property does not have an established building
envelope. The established top of slope for the property would not allow for redevelopment of the property under a
full Stream Margin Review. Initial evaluation for the location of an alternative top of slope does not significantly
improve this situation
The proposed project is requesting a Stream Margin Exemption review approval in order to conduct an extensive
remodel of the existing residence and related features. While the remodel will likely transform the residence, the
footprint remains similar and proposed changes have been presented as remaining under the thresholds required in
meeting the criteria for exemption. Additionally, the project must remain under the 40% demolition threshold as
measured by the Land Use Code – as the home and many of the related features are non-conforming as they relate
to the Stream Margin Review Area.
Importantly, City of Aspen Engineering and Parks Departments will be referral agencies on this project. The applicant
is encouraged to work with these departments to better understand requirements and respond with design solutions
in regards to storm water management, protection/enhancement of riparian zone.

Street address and legal description of the parcel on which development is proposed to occur, consisting
of a current (no older than 6 months) certificate from a title insurance company, an ownership and
encumbrance report, or attorney licensed to practice in the State of Colorado, listing the names of all
owners of the property, and all mortgages, judgments, liens, easements, contracts and agreements
affecting the parcel, and demonstrating the owner’s right to apply for the Development Application. The
purpose of this requirement is to show that the Applicant has the authority to apply for a Land Use Case.
Applicant’s name, address and telephone number in a letter signed by the applicant that states the
name, address and telephone number of the representative authorized to act on behalf of the applicant.
A written description of the proposal and an explanation in written, graphic, or model form of how the
proposed development complies with the review standards relevant to the development application and
relevant land use approvals associated with the property. The relationship of existing development to
proposed development is particularly important to this application in depicting that the exemption
thresholds are met. Clear visual depiction of this relation is required.
A site improvement survey (no older than a year from submittal) including topography, existing
structures, and vegetation showing the current status of the parcel certified by a registered land
surveyor by licensed in the State of Colorado. This survey also is required to depict the 100-year flood
plain, the high water mark of the roaring fork river and the ditch and ditch easement that cross the
property.
Written responses to all exemption criteria.
