The undersigned, an Attorney licensed to practice law in the State of Colorado under
Colorado Supreme Court Registration No. 10240, hereby certifies the ownership of the following
real property located at 1290 Snowbunny Lane, Aspen, Pitkin County, Colorado (the
"Property").
A. PROPERTY
The Land referred to herein below is situated in the County of Pitkin, State of Colorado,
and is described as follows:
Unit 1290, MELVILLE CONDOMINIUMS, according to the Condominium Map thereof
recorded in Plat Book 90 at Page 92, as Reception No. 558191, and the Condominium
Declarations of Melville Condominiums, recorded April 23, 2009, as Reception No.
558192, and the First Amendment to the Condominium Declaration for Melville
Condominiums, recorded July 22, 2009, as Reception No. 561106, Pitkin County,
Colorado.
B. The names of all owners of the Property are as follows:
Melville Family Trust, UTA, dated April 28, 1994
C. I hereby further certify that as of the date hereof, the Property is subject to the
following encumbrances of record:
1. Any and all unpaid taxes, assessments and unredeemed tax sales.
2. Unpatented mining claims; reservations or exceptions in patents or in Acts
authorizing the issuance thereof.
3. Any water rights, claims of title to water, in, on or under the Land.
4. Taxes and assessments for the year 2020, and subsequent years, a lien not yet
due or payable.
5. Right of the proprietor of a vein or lode to extract and remove his ore therefrom,
should the same be found to penetrate or intersect the premises hereby granted, as
described in the United States Patent dated April 19, 1894, and recorded June 16,
1894, in Book 55 at Page 45, as Reception No. 054746.
6. Any and all notes, easements and recitals as disclosed on the recorded Plat of the
Snowbunny Subdivision, recorded May 2, 1957, in Plat Book 2A at Page 229, as
Reception No. 105066.
7. Terms, conditions, provisions, agreements and obligations and Easement 5.00 feet
in width along rear and side lot lines for utility purposes, specified under the
Protective Covenants of Snow Bunny Subdivision, dated May 2, 1957, and
recorded May 2, 1957, in Book 181 at Page 255, as Reception No. 105074.
8. Terms, conditions, provisions, agreements and obligations specified under the
Declaration of Trust for the Benefit of The Property Owners in the Snowbunny

and recorded October 13, 1965, in Book 216 at Page 96, as Reception No.

10. Terms, conditions, provisions, agreements and obligations specified under the
Fence Agreement dated August 2, 1994, and recorded August 3, 1994, in Book
757 at Page 433 as Reception No. 372759; and the Quit Claim Deed dated August
3, 1994, and recorded August 3, 1994, in Book 757 at Page 489 as Reception No.
372791.
11. Terms, conditions, provisions, agreements and obligations specified under the
Resolution of the Aspen Planning and Zoning Commission Approving a
Conditional Use for an Accessory Dwelling Unit to be Located in the Melville
Duplex, 1290 Snowbunny Lane, City of Aspen, Pitkin County, Colorado
(Resolution #99-05) recorded June 21, 1999, as Reception No. 432444.
12. Terms, conditions, provisions, agreements and obligations specified under the
Sidewalk, Curb and Gutter Improvement Agreement, recorded August 2, 1999, as
Reception No. 433973.
13. Any and all notes, easements and recitals as disclosed on the Common Interest
Community Plat of the Melville Condominiums recorded April 23, 2009, in Plat
Book 90 at Page 92 as Reception No. 558191.
14. Terms, provisions, covenants, conditions, restrictions, easements, charges,
assessments and liens provided in the Condominium Declaration of Melville
Condominiums recorded April 23, 2009, as Reception No. 558192; and in the
First Amendment to the Condominium Declaration for Melville Condominiums
dated July 22, 2009, and recorded July 22, 2009, as Reception No. 561106, but
omitting any covenant, condition or restriction, if any, based on race, color,
religion, sex, handicap, familial status, or national origin unless and only to the
extent that the covenant, condition or restriction (a) is exempt under Title 42 of
the United States Code, or (b) relates to handicap, but does not discriminate
against handicapped persons.
16. Terms, conditions, provisions, agreements and obligations specified under the
Notice of Approval, recorded May 1, 2014, as Reception No. 609980.
17. Any and all notes, encroachments, easements and recitals as disclosed on the
Improvement Survey Plat, provided by High Country Engineering, Inc., dated
September 11, 2020, as Project No. 220-1663.
18. Any existing leases or tenancies, and any and all parties claiming by, through or
under said lessees.
