Vos Caudill, Pitkin County, CO NOTICE OF APPROVAL FOR AN ADMINISTRATIVE ENVIRONMENTALLY SENSITIVE AREAS - STREAM MARGIN REVIEW FOR THE REDEVELOPMENT OF A PARCEL OF LAND SITUATED IN SECTION 18, TOWNSHIP 10 SOUTH, RANGE 84 WEST OF THE GTH P.M., CITY OF ASPEN, PITKIN COUNTY, COLORADO, COMMONLY I{NOWN AS 1411 CRYSTAL LAI(E ROAD. PARCEL ID, 2737-181-00-018 APPLICANT: H. Rodes Hart of Valley Group LLC. REPRESENTATIVE: Glenn Horn of Davis Horn, Inc. SUBJECT & SITE OF AMENDMENT: The Applicant seeks approval for an Administrative Stream Margin Review for the redevelopment of a single family home at 1411 Crystal Lake Road. Section 26.435.040[C] Stream margin review standards, of the Land Use Code allows for the Community Development Director to make a determination that the proposed development complies with the requirements of the section. SUMMARY: The applicant is proposing to demolish an existing single family residence and redevelop the property with anew, single family residence. 1411 Crystal Lake Road is adjacent to the Roaring Pork River and lies within the Stream Margin Review Area, On January 14, 2017, the Planning and Zoning Commission considered and approved through Special Review, an alternative Top of Slope for the property (Resolution No. 4, Series of 2017). This newly established Top of Slope and Top of Slope setback provides limitation to the proposed development as it relates'to the river and riparian habitat. The Stream Margin review standards seek to protect the river corridor from development impacts. The Top of Slope and setback serve as the primary lines of delineation for this purpose. In this project, the proposed home and related landscaping are situated entirely outside of the setback area (See Exhibit B). The primary mass of the structure is primarily a single story and respects the 45 degree progressive height limit (See Exhibit C). There is no proposed disturbance or development beyond the Top of Slope setback. The project has submitted a landscaping plan with this application and a lighting plan will be submitted with the building permit submission. REFERRAL COMMENTS: The Application was forwarded to the City of Aspen Engineering and Parks Departments for review. Both agencies had previously evaluated the property for the Top of Slope Special Review and were familiar with the site conditions. In response to the proposed development, Engineering Staff raised no concerns, but will again have a chance to evaluate the project during building permit review. Parks Staff recommended the following conditions of approval: 1. No machinery allowed in between the river and the 15 foot Top of Slope offset. Hand digging only for Riparian re -vegetation. 2. City of Aspen approved native vegetation only to be planted in the 15 foot setback from Top of Slope to river. 3. No perennial flowers in 15 foot Top of Slope setback area. 4. There maybe a change in the Pitkin County Mountain Meadow Seed Mix to City of Aspen Seed mix. Please work with Parks Department to confirm. 5, No tree removals in the stream margin or the 15 foot setback, While not related to the Stream Margin Approval, Parks Staff also wanted to make the Applicant aware of concerns with proposed tree removal for the driveway and turn out in the vicinity of the Riverside Ditch that cuts across the property. As the landscaping and site plans are finalized, please make sure to coordinate with Parks and Utilities staff about any potential impacts to the ditch. STAFF RVALUATION: Planning Staff finds that the proposed redevelopment meets the criteria. specified in Section 26.435.040[q. Exhibit A details these criteria and staff findings, DECISION: The Community Development Director APPROVES Stream Margin Review for the proposed redevelopment at 1411 Crystal Lake Road, subject to the five (5) conditions Iisted above.
