SUBJECT & SITE OF APPROVAL:
The Applicant requests to construct a pool and other related improvements on a property. that is
located within the Stream Margin Review Area. The proposed project is subject to administrative
Stream Margin Review pursuant to Land Use Code Section 26.435.040.B, Exemptions.
SUMMARY:
The subject property is located within one hundred (100) feet, measured horizontally, from the
high-water line of the Roaring Fork River and within a Flood Hazard Area. Because of its
proximity to the river, the property is subject to heightened review as this is considered an
Environmentally Sensitive Area pursuant to Land Use Code Section 26.435.010.b, Stream Margin.
The Stream Margin review standards seek to protect the Roaring Fork River from development
impacts.
The property was previously granted approval for Special Review to establish an alternative Top -
of -Slope by the Planning and Zoning Commission via Resolution No. 4 Series of 2017.1
Administrative Stream Margin Review was subsequently approved in 2018 (Reception No.
645228).

1. The scope of work associated with this Notice of Approval is based on the alternative Top -of -
Slope that was established by the Planning & Zoning Commission.

The home is currently under construction. The Applicant seeks to amend its plan to install a deck
and instead replace portions of the outdoor area with a pool along with landscaping and other
improvements. The scope of this request is limited to the outdoor area adjacent to the Roaring Fork
River.
STAFF EVALUATION:
The proposed pool and associated improvements do not encroach into the Top -of -Slope or the 15-
foot setback. As represented in Figure 1, the outer -most edge of the pool area is located between
two -feet three -inches (2'3") and fourteen -feet one -inch (14' 1") from the required setback line. No
development impacts will occur within the Top -of -Slope setback or in the 100-year floodplain.

Staff finds that the applicant's request meets the criteria associated with Stream Margin Review.
The property will not increase the base flood elevation, no changes to the watercourse are
proposed, there is no development in the 100-year flood plain, and no adjustments are needed to
the building envelope. The applicant has committed to meeting all requirements related to the
City's URMP and any Parks requirements.
Additionally, the applicant has illustrated that the proposed improvements are located below the
45-degree height limitation that is taken from the Top -of -Slope line (Figure 2).

DECISION:
The Community Development Director finds the request for a Stream Margin Review
Exemption at 1411 Crystal Lake Road is consistent with the allowances in Land Use Code
Section 26.435.040.0 and hereby APPROVES Stream Margin Review subject to the
following conditions:
1. The applicant shall apply for and receive a building permit to construct the pool and
associated improvements.
• The permit application shall include a Construction Management Plan. No
construction impacts shall be permitted within the 15-foot Top -of -Slope
setback or within any Flood Hazard Area.
• The permit application shall include details related to pool drainage. Drainage
patterns shall not be oriented towards the 15-foot Top -of -Slope setback or in
the direction of the river.
• The permit application shall include a Tree protection plan. Any required tree
removal permits shall be approved prior to building permit issuance. No
activity or storage of material is.allowed within the Tree Protection Fencing.
2. A silt fence or straw waddles must be installed and inspected prior to any activity
along the 15-foot Top -of -Slope setback.
3. All development and site -disturbance shall be contained within the established
building envelope.
4. During excavation, if sloughing of soil occurs within the 15-foot Top -of -Slope setback,
work shall immediately stop. Parks and Engineering shall be notified, and a site visit
shall occur to determine the best course of action.
5. The conditions of approval established in previous Stream Margin Reviews remain
in full force and effect.
