Parcel ID No. 2737-181-00-018 APPLICANT: Roaring Fork River House, LLC 1411 Crystal Lake Road Aspen, CO 82611 REPRESENTATIVE: Pinon Sage LLC Devin Gardner 700 Redstone Ave Carbondale, CO 81623 SUBJECT & SITE OF APPROVAL: The Applicant has requested a Stream Margin Approval for the addition of a pool and associated improvements. The subject property is located at 1411 Crystal Lake Road, with a Parcel ID of 2737-181-00-018. SUMMARY: The Stream Margin review standards seek to protect the Roaring Fork River from development impacts. The property received Special Review approval in 2017 for an alternative Top of Slope (Resolution No. 4, Series of 2017), and an administrative Stream Margin Approval in 2018 (Reception No. 645228). The property is located adjacent to the Roaring Fork River, and had the 100-year flood plain and top of slope line delineated as part of the previous approvals. The applicant has requested approval to adjust an approved plan for a deck and replace portions of the outdoor area with a pool and associated landscaping and improvements. The home is currently under construction and the request only involves the outdoor area adjacent to the Roaring Fork River. The proposed development is located outside of the top of slope area and outside of the 100-year flood plain, but because the proposed improvements are located closer to the Roaring Fork River than the approved plans, a full stream margin review is required. STAFF EVALUATION: The proposed pool and associated features are located closer to the top of slope, but to not encroach on the top of slope or the required 15 foot setback. Image 1 illustrates that the pool area is located Page 2 of 3 between two-feet three-inches (2’3”) and fourteen-feet one-inch (14’1”) away from the required setback line. No disturbance or development is permitted in the top of slope setback or in the 100- year floodplain. Staff finds that the applicant’s request meets the requirements for the Stream Margin Review. The property will not increase the base flood elevation, no changes to the watercourse are proposed, there is no development in the 100-year flood plain, and no adjustments are needed to the building envelope. The applicant has committed to meeting all requirements related to the City’s URMP and any Parks requirements. Additionally, the applicant has illustrated that the proposed improvements are located below the 45-degree height limitation that is taken from the Top of Slope line, as illustrated in Image 2. Image 1, Pool distance from Top of Slope Image 2, 45 degree height limitation Page 3 of 3 DECISION: The Community Development Director finds the request for Exemption from Stream Margin Review at 1411 Crystal Lake Road as noted above is consistent with the allowances in Land Use Code Section 26.435.040(C) and hereby APPROVES the Stream Margin Review as specified above with the following conditions: 1. The applicant must apply for and receive an application for a building permit for construction of the pool and associated improvements. 2. All conditions of approval from the previous stream margin approval remain in effect. 3. There may be no construction inside the Top of Slope Setback or in the 100-year flood plain. 4. For permit submittal, the project will need to provide a Construction Management Plan and means and methods for how the pool will be constructed without damage to the existing river slope and the river. 5. Detail on pool drainage shall be required as part of the building permit application. The pool cannot drain outside of the building envelope. 6. A tree protection plan must be created, and any required tree removal permits must be approved prior to building permit issuance. No activity or storage of material is allowed within the Tree Protection Fencing. 7. All development and site disturbance must be contained within the established building envelope.
