The Stream Margin review standards seek to protect the Roaring Fork River from development
impacts. This property is located adjacent to the Roaring Fork River, and the applicant has
utilized the existing stream margin maps on file with the City of Aspen to indicate the Top of
Slope and the 100 year flood plain. The area proposed for development is located outside of
each.
STAFF EVALUATION:

Staff finds that the applicant's request meets the
requirements for the Stream Margin Review. The
applicant has utilized mapping from the City, dating
back to 2002, to illustrate the location of the Top of
Slope and the 100 year Flood Plain (mapped AE
Line). For this application, this has been deemed
acceptable given the location of the improvements.
This location for the proposed improvements is to the
side, meaning that the improvements are not located
any closer to the Roaring Fork River than the current
home. The applicant has indicated that no additional
floor area is added as part of this proposal, which will
be confirmed with the building permit application for

Compliance with required setbacks have not been
confirmed and will need to be confirmed as part of
the building permit application. The applicant has
indicated no trees will be removed as part of this project.
DECISION: The Community Development Director finds the request for Exemption from
Stream Margin Review at 1421 Crystal Lake Road as noted above is consistent with the
allowances in Land Use Code Section 26.435.040(B) and hereby APPROVES the Stream
Margin Review as specified above with the following conditions:
1. The applicant must apply for and receive an application for a building permit for
construction of the patio, vault and associated improvements. Setbacks and floor area
calculations will be confirmed at that time.
2. A tree protection plan must be created, and any required tree removal permits must
be approved prior to building permit issuance. No activity or storage of material is
allowed within the Tree Protection Fencing.
3. All development and site disturbance must be contained within the established
building envelope (setbacks).
4. All development installed within the utility easement is installed at risk by the
property owner. If access to any existing utilities, or new utilities are to be placed in
the easement, the property shall remove all development, and provide access to the
easement at the sole cost of the property owner.
5. A drainage narrative and sketch following the Engineering Guidelines for Minor
Grading and Drainage permits must be submitted as part of the building permit.
