CO 81611, AND LEGALLY DESCRIBED AS LOTS A, B, C, D AND E OF THE ASPEN

SUBJECT & SITE OF APPROVAL:
The Applicant has requested an Insubstantial Planned Development (PD) Amendment to adjust
several site improvements and square footage allocations at the Aspen Club and Spa. The property
is legally described as: Lots A, B, C, D and E of the Aspen Club and Spa Subdivision and Planned
Development, with a Parcel ID of 2737-181-70-001, 2737-181-70-002, 2737-181-70-003, and
2737-181-70-004.
SUMMARY:
The applicant specifically requests approval to:
1. Modify configuration of Aspen Club Building lodge units and deck areas (units 15, 16, 17,
18, 19, and 20 see Exhibit A for approximate measurements for all units)
2. Adjust the bedroom count for Aspen Club building lodge unit 19 to 3 bedrooms and unit
20 to 5 bedrooms
3. Adjust the parking lot layout
4. Relocate two site walls
5. Revise deck and pool area square footage allocations
The property was approved for timeshare lodge uses and a recreational club as part of the Aspen
Club and Spa Subdivision and PD originally approved in 2010 (Ordinance 2, Series 2010). The
design of the Club Building has received a series of amendments since, adjusting materials and

roof forms. In 2015, City Council approved more significant changes, including allowing a
synthetic roofing material and other material changes (Ordinance 7, Series 2015). The Aspen Club
also received a notice of approval in 2021 for an Insubstantial PD Amendment and an Insubstantial
Commercial Design Amendment for minor architectural and material adjustments to the club
building and lodge buildings (Reception #682204).
The applicant seeks approval for several changes to Aspen Club and Spa Planned Development.
Club units 19 and 20 will be adjusted. Unit 19 will become a 3-bedroom unit and Unit 20 will
become a 5-bedroom unit. These units were both originally 4-bedroom units. This will change the
square footage of unit 19 to 2,086 sq. ft. with a deck area of 118 sq. ft. and Unit 20 to 3,443 sq. ft.
with 696 sq. ft. of deck area. Additionally, units 15, 16, 17, and 18 will all undergo slight changes
to either their floor area calculations or deck square footage. These overall changes will add 97 sq.
ft. of floor area and 635 sq. ft. of deck area to the project; however, these changes will be within
the dimensional limitations of the approved project. (See Exhibit A for the Club Unit calculations)
The applicant seeks approval for changes to the parking layout. The changes to the parking layout
do not affect the number of parking spaces or the uses that they are allocated to. The changes to
the parking layout reconfigure the number of spaces in certain locations on site. (See Exhibit B for
parking adjustments)
The applicant seeks approval for the relocation of two site walls by the pool area. The change to
the site walls is proposed to conform and comply with underlying zoning restrictions on site walls
in setbacks. (See Exhibit C for site wall adjustments)
The applicant seeks approval to revise the square footage allocations of various deck and landscape
areas around the pool. The recorded PD Plans do not specify square footage for these areas. This
change memorializes the square footage calculations associated with landscaping, the pool area,
and deck areas. (See Exhibit D for square footage allocations)
STAFF EVALUATION:
Staff finds that the applicant's request meets the requirements for an Insubstantial Planned
Development Amendment. The proposed changes are generally consistent with what was
originally approved. While the changes amend floor area and deck area for all Aspen Club Building
lodge units, the amendments are within allowable dimensions for the site. The approval also
provides further clarification to deck area square footage allocations on the site regarding
landscaping and deck spaces. The request does not require variations from any allowed uses. The
amendments represent further refinement to the site from the previous approvals. Overall, staff
finds these adjustments are consistent with the original approvals as well as subsequent
amendments.
The adjustments to the Club units, parking layout, site walls, square footage allocations for the
landscaping, the pool area, and the deck areas are approved. All changes are memorialized in
Exhibits A, B, C, D, and the building permit shall be generally consistent with these Exhibits. It
should be noted that these plans are illustrative in nature and precise information shall be provided
and evaluated as part of the building permit application. In situations where these plans and the
approved building permit differ, the approved building permit shall rule.

DECISION: The Community Development Director finds the request for an Insubstantial
PD Amendment at 1450 Ute Avenue as noted above is consistent with the review criteria and
thereby, APPROVES the Insubstantial PD as specified above.
