Grueter, Pitkin County, CO CERTIFICATE OF NO NEGATIVE EFFECT, COMMERCIAL DESIGN REVIEW AND ADMINISTRATIVE VIEWPLANE REVIEW Applicant: Gravity Haus, with the authorization of the property owner, 315 East Hyman Avenue Holdings LLC Property: 315 E. Hyman Avenue, Wheeler Square Condominium Units 101 to 110, Units 200 to 209, Units 301, 303, 305 and Common Area, City and Townsite of Aspen, Colorado Determination: This 8th day of February, 2023, the following alterations have been approved as represented in Land Use Application LPA-22-102: Replacement of rooftop mechanical equipment, venting and ducting; installation of new mechanical screen walls and a new gate over an electrical equipment alcove; construction of a new roof flashing detail, particularly at the parapet; replacement of the roof membrane; installation of wood siding and steel panels in areas of the south fagade; replacement of a section of existing guardrail; removal of an exterior door and vestibule in the below grade courtyard; and addition of a new door in the below grade courtyard. Certificate of No Negative Effect and Commercial Design Review The subject property is not landmark designated, but is located in the Commercial Core Historic District. The scope of work qualifies for a Certificate of No Negative Effect according to Section 26.415.070.8 of the Aspen Municipal Code in that the scope results in 1) Mechanical equipment or accessory features that have no impact on the character -defining features of the building or structure, and 2) alterations to a noncontributing building within a historic district that have no adverse effect on its historic or architectural character. Similarly, Administrative approval for compliance with Commercial Design Review is appropriate according to Section 26.412.090.A.3. Based on a review of the applicable Commercial, Lodging and Historic District Design Standards and Guidelines, staff finds that the proposal as submitted complies with the design guidelines. ESA Mountain View Plane —Administrative Review The property is located in the foreground of the Wheeler Opera House view plane. According to Section 26.435.E of the Aspen Municipal Code, an addition to a structure or an attached building feature that does not meet the criteria for Exemption from View Plane review may be approved by the Community Development Director through Administrative Review if: 1. The Infringement is erected only to the minimum height needed to accomplish the purpose for which it serves and the height and setbacks comply with the standards of Section 26.575.020, the dimensional requirements of Chapter 26.710, and the Design Guidelines and Standards in Chapter 26.412, Commercial Design Review or 26.415, Historic Preservation, as applicable; or 2. The Infringement cannot be seen with the naked eye from the reference point as demonstrated by a visual resource analysis. The project involves the addition of attached building features, specifically new mechanical equipment and screening on the roof. These elements are new intrusions into the viewplane. The application demonstrates that the equipment and screen walls are all compliant with the height and setback standards applicable to these elements as expressed in Section 26.575.020, Calculations and Measurements and in the Commercial Core Zone District. Applicable design guidelines are also met. The project has designed the HVAC system to the minimum standards to serve the building while limiting impact on the view plane. Approval is granted subject to the following conditions: 1. The new decorative steel plate to be installed on the south fagade is to attach to the building through mortar joints only, not the face of the masonry. 2. The plywood sheathing on top of the trellis facing Hyman Avenue shall be removed in its entirety, as represented in the application. 3. The project does not increase floor area or net leasable area and is therefore exempt from GMQS Review according to Section 26.470.070.E of the Aspen Municipal Code. 4. The project does not change the existing amount of on -site Pedestrian Amenity. 5. The project complies with Second Tier space minimums. 6. The structure is occupied by more than one separately operable tenant. Director Expires 3 years from date of separately issued Development Order. Issuance of this certificate does not exempt the applicant from complying with all City codes, including land use and building codes.
