NOTICE OF APPROVAL
AN ADMINISTRATIVE DETERMINATION OF AN ESTIMATION OF THE PRE-
DEVELOPMENT TOPOGRAPHY OF A SITE COMMONLY KNOWN AS, 1501 SILVER KING
DRIVE, LEGALLY DESCRIBED AS: LOT 21, WEST ASPEN SUBDIVISION, FILING NO. 2,
ACCORDING TO THE PLAT RECORDED SEPTEMBER 4, 1968 IN PLAT BOOK 3 AT PAGE
308, COUNTY OF PITKIN, STATE OF COLORADO.

SUBJECT & SITE OF APPROVAL:
The Community Development Department is issuing this Administrative Determination to accept an
estimation of pre-development topography prepared by a registered land surveyor for the property located
at 1501 Silver King Drive. A Historic Topographical Study has been prepared by Bill W.A. Baker of High
Country Engineering, Inc, P.L.S. 23875, and has been reviewed by the City of Aspen Engineering
Department and has been deemed acceptable.
SUMMARY:
The subject property is in the Moderate-Density Residential (R-15) zone district. The site is currently
improved with a duplex. The current owner plans to remodel the existing duplex and wishes to memorialize
a pre-development topography prior to construction. At the time of this approval, no plans or building
permits have been submitted to the City. The applicant has also provided a description of the methodology
used to prepare the survey illustrating the estimated pre-development topography.
STAFF EVALUATION:
According to the Pitkin County Assessor, the duplex at 1501 Silver King Drive was constructed in 1979.
Documentation of the pre-development topography has not been found in the City or Pitkin County records.
The original construction included manipulation of the land that changed natural grade. As a result,
Engineering and Community Development staff relied on the analysis provided by High Country
Engineering, Inc.
According to the analysis, High Country Engineering, Inc. (HCE) obtained and utilized multiple historic
topographic maps prepared by the U.S. Geologic Survey (USGS) from prior to the subject property’s
development. The analysis states that, “there were no apparent significant grade modifications in the area
beyond the development of the residence on the property. HCE believes that the subdivision essentially
established the historical grade at the time of development for this parcel…”. The analysis states that a valid

historical elevation at the Area of Interest (AOI) appears to be 7836.20’, dropping slightly toward the north,
as depicted on Exhibit A.
The City of Aspen Engineering Department reviewed the analysis and determined that the proposed pre-
development grade is a reasonable representation of the prior site topography.
DECISION:
The Community Development Director accepts the estimation of pre-development topography as
depicted on Exhibit A, prepared by High Country Engineering, Inc. on the basis that the estimate is
consistent with the topography maps that were utilized before the lot was developed.
