Galena St. Aspen, Colorado 81611 RE: Moore Family (Five Trees) Subdivision & PUD Insubstantial Planned Development Amendment Ms. Varga: Please accept this application for an Insubstantial Amendment to the Moore Family Subdivision and Planned Development. The subdivision is commonly referred to as Five Trees. The Five Trees Homeowners Association is the applicant. BendonAdams has been retained to represent the HOA’s interests. This application is submitted pursuant to Sections 26.480.090.B of the City of Aspen Land Use Code. The proposed plat has been prepared according to Chapter 26.490 of the Code. The Moore Family Subdivision is a 180-acre parcel entitled in Pitkin County in the mid to late 1990s for the development of 40 free-market homes, 31 affordable homes, recreation and open space uses, and a parcel and lift associated with the Aspen Valley Ski Club. Final plat approval was granted by the Pitkin County Board of Commissioners in 1998 pursuant to BOCC Resolution #98-57. The plat is recorded with Pitkin County, recorded Five Trees Amendment Page 2 300 SO SPRING ST | 202 | ASPEN, CO 81611 970.925.2855 | BENDONADAMS.COM in book 45 at page 81. A Subdivision Improvements Agreement was established on August 4, 1998, and is recorded with the Pitkin County Recorder at reception number 420467. An extraterritorial water service agreement with the City of Aspen was approved in August 1998. The subdivision was annexed into the City of Aspen in 1999, pursuant to Ordinance 24, Series 1999. The Pitkin County entitlements were accepted by the City of Aspen. The subdivision plat reflects various private open space areas (parcels) and private trail easements. The two snippets above show example open space areas (left image) and private trail easements (right image) depicted in the 1998 subdivision plat.1 Various amendments have been approved over time. A first amended subdivision plat was recorded in 1999 and approved by Pitkin County prior to annexation into the city. This first amendment corrected various distance and curve labels and building envelopes associated with individual lots within Blocks C, D, E, and F; relocated a waterline easement; and, relocated a ski and overpass easement on Moore Drive to reflect the actual location of the improvements. The remaining amendments appear to have been administered by the City of Aspen subsequent to annexation and are predominantly amendments to building envelopes or other dimensional considerations concerning individual residential parcels. Residential lots were also enabled to land up to two City of Aspen TDRs to increase allowable house size from 6,000 square feet to a maximum of 6,500 square feet. 1 Refer to Exhibit 9; page 4 of 9 of final plat of Moore Family Subdivision recorded in book 45 at page 84 Five Trees Amendment Page 3 300 SO SPRING ST | 202 | ASPEN, CO 81611 970.925.2855 | BENDONADAMS.COM Proposal This amendment request is regarding two private trail easements within the subdivision. The aerial image to the right shows the two trails as proposed in the draft plat. Falcon Road Trail The first is a trail aligned with Falcon Road. Falcon Road is shown on the 1998 subdivision plat connecting Powderbowl Trail (road) on the west to Moore Drive on the east. The plat shows Falcon Road separating Lots 16 and 2, bisecting Lots 3, 14, and Open Space Area 6, and separating Lots 11 and 4.2 The image to the right shows the position of Falcon Road as depicted in the 1998 subdivision plat. From the point Falcon Road enters Lot 3 to its intersection with Moore Drive, the width of the road narrows from a 30-foot-wide dimension to a 20-foot-wide dimension. Through Lots 3 and 14, this area is described on the 1998 subdivision plat as a “20’ private access easement & emergency access easement & water easement.” Through the Open Space Area 6 (parcel), the area is described as a “20’ emergency access easement and water easement.” The area bisecting Lots 11 and 4 is described as a “20’ emergency access easement & commond 2 Refer to Exhibit 9; page 4 of 9 of final plat of Moore Family Subdivision recorded in book 45 at page 84 Five Trees Amendment Page 4 300 SO SPRING ST | 202 | ASPEN, CO 81611 970.925.2855 | BENDONADAMS.COM [sic] driveway easement & water easement.” 3 The “commond” driveway easement is described elsewhere as a “common” driveway easement. The image to the right shows open space area/parcel 6, as depicted in the draft plat. The 20-foot-wide easement, from the termination of Falcon Road proper to the connection with Moore Drive has been used as a recreation trail by residents of the subdivision. The trail use dates back to the initial installation of this corridor. This application seeks formal designation of this corridor as serving a recreational trail easement purpose in addition to the other purposes mentioned above. The draft plat highlights this easement area with the additional purpose language. Ski-Back Trail The second component of this proposal is to provide a revised alignment to accommodate a better ski-back alignment. The revised alignment routes through Lots 7, 8, 9, and 28. An insubstantial amendment to an approved Project Review or an approved Detailed Review may be authorized by the Community Development Director. An insubstantial amendment shall meet the following criteria: 1. The request does not change the use or character of the development. Response – The character of the Subdivision and Planned Development will be unaffected by these changes. The Falcon Road trail area through portions of lots 3, 4, 6, 11, and 14 has been used as a recreational trail for years. Including this on the plat will reflect the long-standing pattern of use of this area. The new alignment for the trail easement through portions of lots 5, 7, 8, 9, and 28 will enhance ski-back capability but will not affect the basic character of the subdivision. 2. The request is consistent with the conditions and representations in the project's original approval, or otherwise represents an insubstantial change. Response – The request is both consistent with the original approvals and representative of an insubstantial change. The subdivision was originally envisioned with private open spaces and recreational trail facilities for residents of the subdivision to enjoy. The Falcon Road connection through portions of lots 3, 4, 6, 11, and 14 has been used as a recreational trail since the subdivision infrastructure was installed and contains a reasonably flat pathway-enabled use. Formally platting this element of the subdivision is consistent with the intent to have private trail easements within the subdivision and represents an insubstantial change reflective of historic and ongoing use patterns. The ski-back accommodation through portions of lots 5, 7, 8, 9 and 28 is consistent with the original intent of the recreational trail layout. The change is insubstantial in nature to enable better alignment and accommodation for using the trail system while on skis. 3. The request does not require granting a variation from the project's allowed use(s) and does not request an increase in the allowed height or floor area. Response – No variance to uses are requested or required for this change and no variations in height or floor area are necessary. 4. Any proposed changes to the approved dimensional requirements are limited to a technical nature, respond to a design parameter that could not have been foreseen during the Project Review approval, are within dimensional tolerances stated in the Project Review, or otherwise represents an insubstantial change. Response – No changes to the approved dimensional limitations are proposed. 5. An applicant may not apply for Detailed Review if an amendment is pending. Exhibit 1 Review Criteria page 2 Response – Detailed review is not anticipated to be needed to accommodate this amendment. 26.480.090.B Insubstantial amendment. An insubstantial amendment to an approved subdivision or between adjacent subdivisions may be authorized by the Community Development Director. An insubstantial amendment shall be limited to technical or engineering considerations which could not reasonably have been anticipated during the approval process or any other minor change to a subdivision which the Community Development Director finds has no substantial effect upon the subdivision or to the allowances and limitations of the subdivision Response – The proposed amendments will have no substantive effect on the subdivision and will not affect the allowances and limitations of the approval. The subdivision was originally envisioned with private open spaces and recreational trail facilities for residents of the subdivision to enjoy. The Falcon Road connection through portions of lots 3, 4, 6, 11, and 14 has been used as a recreational facility since the subdivision infrastructure was installed and a reasonably flat connection-enabled use. Formally platting this element of the subdivision will accommodate the historic and ongoing use of this area as a recreational trail. Formalizing this use pattern through an easement reflected on a plat is the technical mechanism to accommodate a pattern of use already established and is consistent with the intent to have private trail easements within the subdivision. The ski-back accommodation through portions of lots 5, 7, 8, 9, and 28 is consistent with the original intent of the recreational trail layout. The change is both technical and insubstantial in nature. The amendment is insubstantial in that the routing of recreational trails through the subdivision has always been a component of the project. It is technical in nature in that the grades and alignment proposed will better accommodate users on skis and the recordation of an easement on a plat is the technique and mechanism to reflect the location of an easement within a subdivision. 26.490.040.A Subdivision Plat. Subdivision plats required by Chapter 26.480—Subdivision plats, including condominium plats and any change to a platted legal description of a parcel, shall contain the information and be in the format required by Title 29—Engineering Design Standards, Plats.
