RE: Gordon Stream Margin Exemption

SUMMARY: The applicant proposes to build an entryway at thefrontdoorofasinglefamilyhome. The home is within 100 feetofthe100yearfloodline. The applicant has applied for aStreamMarginExemption. Staff recommends denial of theexemption. The applicant must submit an application for StreamMarginReview.
REFERRAL COMMENTS: Please see attached comments from theEngineeringDepartment.
FINDINGS: Pursuant to Section 7-504 the following standardsapplyforStreamMarginExemption:
1. The development does not add more than ten percent (10~j tothefloorareaoftheexistingstructureorincreasetheamountofbuildingareaexemptfromfloorareacalculationsbymorethantwenty-five percent (25%).
RESPONSE: The proposed entry is approximately 176 square feetwhichisapproximately4$ of the existing floor area.
2. The development does not require the removal of any tree forwhichapermitwouldberequiredpursuanttoSection13-76 or theapplicantreceivesapermitpursuanttosaidsubsection.
RESPONSE: No trees shall be removed for the entry.
3. The development is located such that no portion of theexpansion, remodeling or reconstruction will be any closer to thehighwaterlinethanistheexistingdevelopment.
RESPONSE: The addition is proposed for the northern side of thehousewhichisperpendiculartoCastleCreek. It is no closer tothehighwaterlinethantheexistingdevelopment.
4. The development does not fall outside of an approved buildingenvelope, if one has been designated through a prior review.
RESPONSE: The entry will extend beyond the existing residence.
5. The development is located completely outside of the SpecialFloodHazardAreaandmorethanonehundredfeet (100') measured
horizontally, from the high water line of the Roaring Fork Riveranditstributarystreamsortheexpansion, remodeling orreconstructionwillcausenoincreasetotheamountofgroundcoverageofstructureswithintheSpecialFloodHazardArea.
RESPONSE: The addition will increase the ground coverage byapproximately90feet. According to the FEMA map the flood plainextendsupintotheparcelandgoesrightthroughthemiddleofthehome. Because of this discrepancy between the applicant'smapandtheactualFEMAmap, the applicant must submit a map thatshowstherelationoftheproposedadditiontothefloodplainandmustdeterminewhethertheadditionwillchangethebasefloodelevation. it is recommended that the applicant submit anapplicationforacompleteStreamMarginReview.
in addition, there are two hot tubs that were built on site,without Stream Margin Review, that are well within the floodplain. One of the tubs is over the property line. The applicanthasagreedtoremovethosetubsasaconditionofStreamMarginApproval.
RECOMMENDATION: Staff recommends that the Planning Director denytheStreamMarginExemption. It is necessary for a Stream MarginReviewapplicationtobesubmittedshowingthetrue100yearfloodplain, a base flood elevation certificate, and an elevationoftheproposedentrysoreviewcandetermineiftheentrywillincreasethebasefloodelevation.
