Body: Good Afternoon Alison, I have completed the zoning review and can formally sign-off for Zoning on this permit once the TDR is extinguished. Please be aware that not all permit review groups have evaluated the permit yet, including Building. The TDR should not be extinguished until after all Building Permit Review Agencies have signed-off on the Permit except for Zoning. Following are the steps for extinguishing the TDR: 1. The steps are as follows: a. The Historic Preservation Officer requires the following information before they can generate a letter documenting the landing of the TDR(s): i. Name and address of the owner of the TDR(s), ii. TDR(s) Certificate Number(s) that are to be extinguished (Should be a single to triple digit number on the upper right corner of the Certificate) iii. Address of the site where the TDR(s) is/are to be landed iv. Building Permit number related to the landing of the TDR(s). 2. The Historic Preservation Officer generates a letter documenting the landing of the TDR(s) 3. A meeting is scheduled to extinguish the TDR(s). A Notary is not needed for this step. i. The Owner of the TDR(s) has to present the TDR(s) Certificates to the Historic Preservation Officer for extinguishment. If the Owner cannot be present, then: 1. The Historic Preservation Officer must be provided with a Power of Attorney authorizing whoever will be handing the Historic Preservation Officer the TDR(s) Certificate(s) to do so. 2. The Historic Preservation Officer sends the Power of Attorney to the City Attorney’s Office for approval prior to scheduling a meeting with the applicant to extinguish the TDR(s). 4. Upon receipt of the TDR(s) Certificate(s) to be extinguished, the Historic Preservation Officer then: a. Stamps the certificate with the “Extinguished” stamp available in the office and writes the date of extinguishment in the stamped area. b. Scans the front and back of the extinguished TDR. c. Emails the TDR owner the scanned extinguished TDR and TDR extinguishment letter. d. Emails the Zoning staff member who reviewed the Building Permit the scanned extinguished TDR and TDR extinguishment letter. 5. The Zoning staff member uploads the TDR and extinguishment letter into both Bluebeam and Salesforce for the applicable Building Permit, and then formally signs-off on the Building Permit. Regarding Impact Fees: The Parks fee was mitigated at the time when the final plat was approved. The Affordable Housing Mitigation was mitigated with 7 deed restricted units in the multi-family building on Lot 7. The School Land fee-in-lieu is applicable; however, there are no additional school land fees generated as a result of this permit. The only fee that does apply is the TDM/Air Quality fee, which is $21.35 for the net gain in floor area. The TDM/Air Quality fee has been added into the fees due at the time of permit issuance. Building plan check is only one part of the often complex process by which projects are reviewed for approval. These parts are interrelated and are sometimes conflicting. The application does not include a current topographic survey of the subject property in order to facilitate calculation of Net Lot Area per Section 26.575.020.c, Measuring Net Lot Area. In turn, once the Net Lot Area is ascertained, then the calculation for the amount of allowable floor area, per the R-15A zone district, is allowed. In your existing and proposed Floor Area calculations, you are using the gross lot area to calculate allowable floor area.
