SUMMARY: The applicant has requested an Insubstantial Amendment- Stream Margin, in order to record a new Stream Margin Review Plan for 120 Red Mountain Road. The property was developed with a single family home in 1962. Current land use regulations related to "Environmentally Sensitive Areas" would require construction to be pulled further away from Hunter Creek than the home was placed. The property owner voluntarily designated the existing residence as an Aspen landmark and requested land use approvals for an expansion. The historic portions of the building, non-conforming conditions included, were required to be retained. The owner received approval for modest building additions where deemed appropriate. A building envelope was established to delineate the location for any future development of the site. The building envelope was to closely follow the perimeter of the existing house on its north and east sides. On the north side of the house, an existing deck was not properly drawn on the original Stream Margin Review Plan. The deck has not been changed, but an as-built survey undertaken in preparation for Certificate of Occupancy has revealed that the deck pierces the approved building envelope. The applicant requests an amendment to the envelope to properly accommodate this historic feature of the home. The Stream Margin review included an allowance for the envelope to "flare out" at the northeast corner ofthe historic house to accommodate a new bathroom expansion which is cantilevered above the ground. In drawing the plat, the surveyor kept the envelope too close to the existing building and did not allow enough space for the approved addition. This omission was overlooked. At project completion, it has been determined that the bathroom extension is approximately 18" outside ofthe platted envelope. The applicant requests an administrative Insubstantial Stream Margin Amendment to allow for a new plat that is drawn to correctly represent the approved project. A drawing representing the proposed changes is attached to this Notice of Approval. A new plat must be reviewed and recorded. No other aspects of the plat are proposed to be changed, however the applicant completed a boundary adjustment to swap a 12 square foot area with an adjoining property in July 2015. This revised plat depicting the Stream Margin approval should be updated to show the newly defined property boundary. STAFF EVALUATION: Staff finds that the request meets the requirements of an Insubstantial Amendment- Stream Margin. The proposal is consistent with the original approvals. A site plan that was prepared by the architect was used during the Stream Margin Review process that showed the existing home and the two areas of addition that were being proposed. The building envelope that was proposed/shown on this Site Plan was drawn as close to the existing building as feasible where there was no work to be done. In the areas of the new construction, we proposed the building envelope a couple feet outside the line of framing to accommodate the structure below grade and give the workers space to move around the building. This Site Plan is what was approved by HPC and City Council. In the process of recording the plat with the new building envelope, the line was adjusted per comments from Amy. Unfortunately, the line was moved more than intended and resulted in a building envelope that does not encompass all that was approved and that has been constructed. This mistake went unnoticed by the Architect, the surveyor, Amy or HPC staff, or anyone in the various departments of the building department during the permitting process. It was discovered when the civil engineer was creating an as-built drawing of the civil work and the building envelope. Below you will find the Site Plan that was approved; the documents that explain how this mistake was made; and the proposed adjusted building envelope. You will also find the responses to the pre-application letter from Amy Simon. 802 E. Section 26.435.040.C - Environmentally Sensitive Areas - Stream Margin Review Standards Please see the attached Stream Margin Review Application prepared by Alan Richman for the original application in March, 2014; attached. In Summary: 1. The approved and constructed development does not have any impact on the base flood elevation of Hunter Creek. 2. The applicant is not aware of any trails or open space recommendations that would be impact this property. 3. The construction that was built, resulted in no vegetation being removed from the stream bank, as the small addition was cantilevered over the bank. The garage addition was built above the top of bank. 4. The development has not and will not interfere with or change the course of Hunter Creek. 5. Not applicable 6. Not applicable 7. The site visit with the City Engineer confirmed that the wetland and riparian zone of this property is located below the top of bank. No development was done in this area. Section 26.435.100.A - Insubstantial Amendment of an ESA Development Order 1. The development order for this project is valid in every way, having gone through the HPC approval process for the Residential Design Standards, AspenModern application and the Stream Margin Review. The approved Site Plan was followed during construction and the intent of the Stream Margin Review was met. 2. The development order and new construction that was approved remain in conformance with the review criteria for the Stream Margin Review. The approved documents were followed throughout construction. The problem lies in the mistake on the recorded plat that didn't match the approved Site Plan. 3. The only change we are requesting is to correct a mistake on the recorded plat; everything approved during the Stream Margin Review was followed and , conditions met; thus making the recorded plat match the approved site plan and to bring the building envelope that is recorded encompass all the development that was approved and has now been constructed. 4. The change is in compliance with all other sections of Title 26; having been through the appropriate approval process. This is just a correction to the recorded plat. Vos Caudil. itkin County, COi A RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION RECOMMENDING THE ASPEN CITY COUNCIL APPROVE ASPENMODERN HISTORIC LANDMARK DESIGNATION FOR THE PROPERTY LOCATED AT 120 RED MOUNTAIN ROAD, CITY AND TOWNSITE OF ASPEN, COLORADO, AND APPROVING CONCEPTUAL MAJOR DEVELOPMENT AND STREAM MARGIN REVIEW RESOLUTION #15, SERIES OF 2014 PARCEL ID: 2737-072-00-028 WHEREAS, the applicant. Red Mountain Riverfront. LLC, represented by Kim Raymond Architects and Alan Richman Planning Services, has requested that the property located at 120 Red Mountain Road, City and Townsite of Aspen, Colorado be considered for voluntary historic designation through the AspenModem process described at Section 26.415.025 and Section 26.415.030 ofthe Municipal Code; and WHEREAS, the applicant also requested approval for Conceptual Major Development and Stream Margin review; and WHEREAS, Section 26.415.070 of the Municipal Code states that "no building or structure shall be erected, constructed, enlarged, allcied, repaired, relocated or improved involving a designated historic properly or district until plans or sufficient information have been submitted to the Community Development Director and approved in accordance with the procedures established for their review;" and WHEREAS, for Conceptual Major Development Review, the HPC must review the application, a staff analysis report and the evidence presented at a hearing te determine the project's conformance with the City of Aspen Historic Preservation Design Guidelines per Section 26.415.070.D.3.b.2 and 3 of the Municipal Code and other applicable Code Sections. The HPC may approve, disapprove: appruve with conditions or comincie the application m obtain additional information necessary to make a decision to approve or deny; and WHEREAS, the property is located along Hunter Creek and is subject to the City's regulations on stream margin development as stated at Section 26.435.040 of the Municipal Code; and WHEREAS, Amy Simon, in her staff report to HPC dated May 28,2014, performed an analysis of the application based on the standards. The staff recommendation was that the property should be designated a landmark as it meets the criteria for designation and the integrity score qualifies as the "best" ·category of historic resources. NOW, THEREFORE, BE IT RESOLVED: That HPC hereby finds that the property located at 120 Red Mountain Road, City and Townsite of Aspen, Colorado meets the designation criteria of Land Use Code Section 26.415.025 and 030. HPC hereby approves Conceptual Major Development and Stream Margin Review with the following conditions: 1. HPC finds that 120 Red Mountain Road meets designation criteria a, c, and e, listed in §26.415.030,C,1 2. HI?C finds that 120 Red Mountain Road is a "best" example of Modem architecture. 3, HPC grants Stream Margin Review approval for the subject property. All new development within the development boundary shall be set back fifteen (15) feet from the top-of-slope, except for the areas depicted on the approved plans. 4. A riparian restoration plan approved by the City of Aspen Parks Department and Engineering Department shall be required as part of the building permit application for this property. The restoration plan shall require implementation prior to issuance of a Certificate of Occupancy. 5. 11PC grants a Variance from the progressive height limit related to Stream Margin Review, as depicted on the approved plans. 6. A Building Envelope for this property shall be prepared by the applicant for approval by the City Engineer and the Community Development Director. The map shall describe and depict a building envelope which, on the south and east boundaries goes no further below the top of slope than the existing home footprint and the area of the proposed new garage. The north and west boundaries shall relate to setback requirements. The map shall also indicate and tabulate all areas of the property above and below the high water line, those areas affected hy steep slopes, and those areas affected by right-of- way or access easements. This plat shall be attached to and recorded along with this Resolution. A 24" x 36" copy of the map shall also be retained in the planning file and the building address file. 7. In the event the event the existing house and planned addition are demolished in the future and the property is redeveloped, the building envelope created as a result of this resolution shall be null and void and the property will be subject to applicable land use reviews at the time o f redevelopment. 8. Council shall determine ifa Fisherman's Easement is appropriate to require as part ofthis land use review process. 9, A development application for a Final Development Plan shall be submitted within one (1) year ofthe date of approval.of a Conceptual Dewlopment Plan. Failure to file such an application within th:is time period shall render null and void lhe approval of the Conceptual Development Plan. The Historic Preservation Commission may, at its sole discretion and fur good cause shown, grant a one-time extension ofthe expiration date for a Conceptual Development Plan approval for up to six (6) months provided a written request for extension is received no less than thirty (30) days prior to the expiration date. The home was constructed before Stream Marg-in regulations were adopted and positioned in a manner that would not be allowed today. A new property owner was granted approval to make minor additions and a building envelope was required to be platted. The building envelope was to closely follow the perimeter of the existing house on its north and east sides. The envelope was permitted to 'flare out" at the northeast to accommodate the approved additions. In drawing the plat, which was later recorded, the surveyor did not allow enough space for part of the addjtjon that underwent Stream Margin review. Now that the project is built and ready for Certificate of Occupancy, it has been determined that a bathroom extension is approximately 18" outside of the platted envelope. The applicant requests an administrative Insubstantial Stream Margin Amendment to allow for a new plat that is drawn to correctly represent the approved project.
